REQUEST FOR COUNCIL ACTION Q ~ CITY COUNCIL MEETING DATE: CLERK OF COUNCIL USE ONLY: SEPTEMBER 20, 2004 TITLE: APPROPRIATION ADJUSTMENT RECOGNIZING CONDBMNATION FONDS FOR THE BRISTOL AND MACARTHUR INTERSECTION - PROJECT 1745 APPROVED o As Recommended o As Amended o Ordinance on 151 Reading o Ordinance on 2nd Reading o Implementing Resolution o Set Public Hearing For CONTINUED TO FILE NUMBER RECOMMENDED ACTION Approve an appropriation adjustment recognizing funds in the amount of $53,115 in the Measure M Street Construction Fund (account no. 32-01- 5621) and appropriating $53,115 to the Measure M Street Construction Fund (account no. 32-551-6631, project no. 1745) for the Bristol Street and MacArthur Boulevard intersection project. DISCUSSION To accommodate the street widening at the intersection of Bristol Street and MacArthur Boulevard, acquisition of portions of the properties at 3329-3365 South Bristol Street and 3600 South Bristol Street was required. Good faith offers were made to the property owners in the amounts of $73,890 and $129,225 respectively, for the purchase of the properties. Eminent domain proceedings for both properties were necessary since negotiations with property owners were not successful. In May 2003 the City deposited funds into the State Condemnation Fund for these proceedings. After final settlements the City received a refund of $53,115 from the State Condemnation Fund. In order to recognize these funds in the current fiscal year, an appropriation adjustment is necessary. Construction of the intersection widening was completed in June of 2004. ENVIRONMENTAL IMPACT In accordance with the California Environmental Quality Act, Mitigated Negative Declaration and Mitigation Monitoring Program, E.R. No. 2003-45 has been prepared for this project. 208-1
