<br />REQUEST FOR <br />COUNCIL ACTION <br /> <br />Q <br />~ <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />SEPTEMBER 20, 2004 <br /> <br />TITLE: <br />APPROPRIATION ADJUSTMENT <br />RECOGNIZING CONDBMNATION <br />FONDS FOR THE BRISTOL AND <br />MACARTHUR INTERSECTION - <br />PROJECT 1745 <br /> <br />APPROVED <br />o As Recommended <br />o As Amended <br />o Ordinance on 151 Reading <br />o Ordinance on 2nd Reading <br />o Implementing Resolution <br />o Set Public Hearing For <br /> <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />Approve an appropriation adjustment recognizing funds in the amount of <br />$53,115 in the Measure M Street Construction Fund (account no. 32-01- <br />5621) and appropriating $53,115 to the Measure M Street Construction Fund <br />(account no. 32-551-6631, project no. 1745) for the Bristol Street and <br />MacArthur Boulevard intersection project. <br /> <br />DISCUSSION <br /> <br />To accommodate the street widening at the intersection of Bristol Street <br />and MacArthur Boulevard, acquisition of portions of the properties at <br />3329-3365 South Bristol Street and 3600 South Bristol Street was <br />required. Good faith offers were made to the property owners in the <br />amounts of $73,890 and $129,225 respectively, for the purchase of the <br />properties. <br /> <br />Eminent domain proceedings for both properties were necessary since <br />negotiations with property owners were not successful. In May 2003 the <br />City deposited funds into the State Condemnation Fund for these <br />proceedings. After final settlements the City received a refund of <br />$53,115 from the State Condemnation Fund. In order to recognize these <br />funds in the current fiscal year, an appropriation adjustment is <br />necessary. Construction of the intersection widening was completed in <br />June of 2004. <br /> <br />ENVIRONMENTAL IMPACT <br /> <br />In accordance with the California Environmental Quality Act, Mitigated <br />Negative Declaration and Mitigation Monitoring Program, E.R. No. 2003-45 <br />has been prepared for this project. <br /> <br />208-1 <br />
