<br /> <br /> <br />use permit would be contrary to the following goals of the <br />Land Use Element of the General Plan: Goal 1 ("Promote a <br />balance of land uses to address basic community needs"), <br />Goal 2 ("Promote land uses which enhance the City's <br />economic and fiscal viability"), Goal 4 ("Protect and enhance <br />development sites and districts which are unique community <br />assets that enhance the quality of life"). Because of its <br />adjacency to a residential neighborhood both north and east, <br />approval of the conditional use permit for a use with the <br />noise impacts testified to at the public hearing would be <br />contrary to Goal 3 ("Preserve and improve the character and <br />integrity of existing neighborhoods"). <br /> <br />G. In accordance with the California Environmental Quality Act, this is not a <br />project; no environmental documentation is necessary for this project. <br /> <br />Section 2. The City Council of the City of Santa Ana after conducting the <br />public hearing herby denies Conditional Use Permit No. 2004-06 and Appeal No. 2004- <br />06. This decision is based upon the evidence submitted at the abovesaid hearing, <br />which includes but not is not limited to: the Request for Council Action dated October 4, <br />2004 and exhibits attached thereto; and the public testimony written and oral, all of <br />which are incorporated herein by this reference. <br /> <br />Section 3. This decision rendered by the City Council of the City of Santa Ana <br />is final and is subject to judicial review pursuant to California Code of Civil Procedure <br />section 1094.6.
