use permit would be contrary to the following goals of the Land Use Element of the General Plan: Goal 1 ("Promote a balance of land uses to address basic community needs"), Goal 2 ("Promote land uses which enhance the City's economic and fiscal viability"), Goal 4 ("Protect and enhance development sites and districts which are unique community assets that enhance the quality of life"). Because of its adjacency to a residential neighborhood both north and east, approval of the conditional use permit for a use with the noise impacts testified to at the public hearing would be contrary to Goal 3 ("Preserve and improve the character and integrity of existing neighborhoods"). G. In accordance with the California Environmental Quality Act, this is not a project; no environmental documentation is necessary for this project. Section 2. The City Council of the City of Santa Ana after conducting the public hearing herby denies Conditional Use Permit No. 2004-06 and Appeal No. 2004- 06. This decision is based upon the evidence submitted at the abovesaid hearing, which includes but not is not limited to: the Request for Council Action dated October 4, 2004 and exhibits attached thereto; and the public testimony written and oral, all of which are incorporated herein by this reference. Section 3. This decision rendered by the City Council of the City of Santa Ana is final and is subject to judicial review pursuant to California Code of Civil Procedure section 1094.6.
