RESOLUTION 73-60 - ESTABLISHING UNDERGROUND UTILITY DISTRICT <br />NO. 6 was adopted on motion of Councilman Griset, seconded <br />by Councilman Markel, and carried on the following vote: <br /> <br />AYES: Griset, Markel, Garthe, Yamamoto, Patterson, Ward <br />NOES: None <br /> <br />ABSENT: Evans (CA 134) <br /> <br />PUBLIC HEARING <br />APPEAL # 320 <br />CITIZENS FOR FAIR ZONING ASSOC. <br />MABURY HOMEOWNERS ASSOC. <br /> <br />Homeowners Association appealing <br />approval of Variance Application <br />garden apartment complex at 1350 North Cabrillo Park Drive <br />the R 4 and R 1 Districts with the following exceptions: <br /> <br />The Mayor opened the <br />public hearing on Appeal <br /># 320, filed by the <br />Citizens for Fair Zoning <br />Association and Mabury <br />the Planning Commission's <br />73-6 to construct a 290 unit <br /> in <br /> <br />A. To allow surface parking and a two-story <br /> apartment building in the R 1 zone; <br /> <br />To allow two-story apartment buildings <br />in excess of 20 feet in height within 150 <br />feet of property zoned R 1; and <br /> <br />C. To allow a reduction of open space from <br /> 50% to 49% of the total site area. <br /> <br />The Planning Director reviewed the Planning Commission Findings <br />of Fact dated May 14, 1973, and summarized the zoning history <br />of the proposed site. Following this, a summarization of the <br />Environmental Impact Report was given by Robert Sundstrom of <br />the Planning Department and details of the proposed variance <br />were given by Bill Daugherty of the Planning Department. <br /> <br />The Clerk reported there were no written communications. <br /> <br />RECESS <br /> <br />the audience. The meeting <br />Councilmen present. <br /> <br /> At 9:00 P.M., the Mayor <br /> declared a recess before <br /> calling for testimony from <br />reconvened at 9:10 P.M. with the same <br /> <br />APPEAL # 320 Continued <br />hearing on Appeal # 320. <br /> <br />The Mayor called for <br />testimony from the <br />audience in the public <br /> <br />Mr. Gordon Bricken, 1017 North Wright, speaking on behalf of <br />the appellants, recalled for Council some of the proceedings <br />related to a variance which had been obtained in 1971 for <br />construction of the "Redwoods" apartment complex just south <br />of the proposed site, and stated that the "Redwoods" project <br />was very similar to the one proposed; however, at that time <br />the applicant had been willing to trade off certain acreage <br />to be included in an adjoining park in return for parking <br />areas within an R 1 buffer zone; that the applicant for Variance <br />73-6 was offering no such trade; that they simply wanted to build <br />apartments in the R 1 buffer zone; that not only should they not <br />be allowed to build within that zone, but the entire buffer <br />zone should be dedicated as an extension of the adjoining park; <br />that the decrease in number of units and the resulting decrease <br />in income to the developer would have to be offset by increased <br /> <br />CITY COUNCIL MINUTES 197 JUNE 4, 1973 <br /> <br /> <br />
