<br />N-2004-090 <br /> <br />~ <br /> <br />. <br />lNSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />, ~~31-DÝ- <br />CLERK OF COUNCI~J <br />DATE: g'-/7-o, <br /> <br />THIRD AMENDMENT TO <br />CONSUL T ANT AGREEMENT <br /> <br />c. f/) <br />h'ScAV <br /> <br />THIS ¡PIRD AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on the L. day of fu-/¡ ,2004 by and between Daniel Achatz <br />("Consultant") and the City 0 Santa Ana, a charter CIty and mUnIcIpal corporatIOn, <br />organized and existing under the Constitution and laws of the State of California ("City"). <br /> <br />Recitals: <br /> <br />A. City and Consultant entered into Consultant Agreement N2002-048, dated February <br />28, 2002, (hereinafter "said Agreement") by which Consultant has provided <br />counseling and instructional services to inmates housed at the Santa Ana City Jail. <br /> <br />B. The parties amended said Agreement (N2002-128, dated August 1,2002 and N2003- <br />071, dated July 1,2003) to increase the compensation and extend the term. <br /> <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term and amend the Scope of Services of said Agreement. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject to <br />all the terms and conditions of said Agreement and Amendments, except those amended in <br />this Third Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 2, COMPENSATION, shall be amended to read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for his services, an <br />hourly rate of thirty-seven dollars ($37.00) for all scheduled instructional and counseling <br />services. The total sum to be expended pursuant to said Agreement and Amendments <br />shall not exceed $10,000.00, annually, during the term of said Agreement." <br /> <br />2. Section 3, TERM, shall be amended to read as follows: <br /> <br />"This Agreement shall commence on the February 28,2002 and terminate on June 30, <br />2005, unless terminated earlier in accordance with Section 12, below.
