<br />tJ- dD03 ---/3'1 -~ <br /> <br />SECOND AMENDMENT TO <br />CONSUL T ANT AGREEMENT <br /> <br />THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on the 28th day of June 2004, by and between Bartel Associates, LLC ("Consultant") <br />and the City of Santa Ana ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into Consultant Agreement N-2003-134, dated September 17, <br />2003, (hereinafter "said Agreement") by which Consultant has provided actuarial <br />consulting services to the City. <br /> <br />B. The parties wish to extend the term of said Agreement for an additional one-year <br />term. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this Second <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 3, TERM, shall be amended to read as follows: <br /> <br />"This Agreement shall commence on September 17, 2003 and terminate on June 30, <br />2005, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Executive Director <br />of the Community Development Agency and the City Attorney." <br /> <br />IN WITNESS WHEREOF, the parties hereto have executed this Second Amendment to <br />Consultant Agreement on the date and year first written above. <br /> <br />APPROVED AS TO FORM: <br /> <br />CITY OF SANTA ANA <br /> <br />r/~'"I g f& <br />JÔSEPH W.
