Recitals: A. The parties entered into Agreement No. N-2003-042 dated April 29, 2003, (hereinafter "said Agreement") by which Consultant cleans the Police Department shooting ranges and removes lead therefrom. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend said Agreement for an additional one-year period and increase the compensation to pay for services during that one year period. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Second Amendment to Consultant Agreement, the parties agree as follows: 1. Section 2.a., COMPENSATION, shall be amended to read as follows: "City agrees to pay and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A-I of said Agreement. The sum to be expended under this Agreement shall not exceed $6,500.00 during the 2004-05 fiscal year." 2. Section 3, TERM, shall be amended to read as follows: "This Agreement shall commence on April 29, 2003 and terminated on June 30, 2005, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Chief of Police and the City Attorney." 3. Except as hereinabove modified, all terms and conditions of said Agreement shall remain in full force and effect. II II II
