<br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />':3-1-c6 <br /> <br />~Ä~~~ ~- ~IU_N~14 CONTRACTOR AGREEMENT <br /> <br />t :-Pw'¡!t THIS AGREEMENT made and entered into this 4¿ day of h ~ ' 2004 by <br />[Þ.VrbìJ\.) and between Hernandez Cart Service, Inc., a California corporation (hereinafter' ontractor"), <br />and the City of Santa Ana, a charter city and municipal corporation organized and existing under <br />the Constitution and laws of the State of California (hereinafter "City"). <br /> <br />A-2004-134 <br /> <br />RECITALS <br /> <br />A. The City desires to retain a Contractor having special skill and knowledge in the field of <br />locating and retrieving unattended shopping carts. <br /> <br />B. Contractor represents that Contractor is able and willing to provide such services to the <br />City. <br /> <br />C. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services performed by Contractor under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br /> <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br /> <br />1. <br /> <br />SCOPE OF SERVICES <br /> <br />Contractor shall perform the following services: <br /> <br />a. <br /> <br />Collect all unattended shopping carts from the public right-of-ways and private <br />property, as directed by the City. Contractor is required to canvas the City each day <br />of the week and retrieve unattended shopping carts. Those carts properly identified, <br />as defined by state law, will be returned to the appropriate stores and those not <br />properly identified shall be delivered to the City Corporate Yard. <br /> <br />b. Contractor shall provide City with a toll free "hotline" phone number where the City, <br />residents and business owners can report unattended carts. Contractor shall respond <br />to all calls to the hotline within a twenty-four (24) hour period. <br /> <br />c. <br /> <br />Contractor shall dedicate two drivers and two vehicles exclusively to the City, seven <br />days a week, eight hours a day in two staggered shifts (7:00 a.m. to 4:00 p.m. and <br />10:00 a.m. to 7:00 p.m.). The drivers shall carry appropriate identification <br />indicating they are performing services under contract to the City of Santa Ana. <br />Holidays observed will include New Year's Day, Memorial Day, Independence Day, <br />Labor Day, Thanksgiving day and Christmas day. <br />
