<br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />Q-\-ö5 <br /> <br />CLERK OF COUNCIL FOURTH AMENDMENT TO AGREEMENT <br />DATE: ~..q -0 Y <br /> <br />THIS AMENDMENT, made and entered into this ~ +" day of July, 2004, between the <br />City of Santa Ana, a charter city and municipal corporation duly organized and existing under the <br />Constitution and laws of the State ofCalifomÎa ("City"), and Tiburon, Inc. ("Consultant"). <br /> <br />A-2004-130 <br /> <br />c', rD <br />fA-st~e.l <br /> <br />RECITALS <br /> <br />A. The City and the Consultant entered that certain agreement dated August 28, 2000, <br />hereinafter referred to as "said Agreement", to provide computer support services for the City's <br />dispatch, message switch and corrections management systems and equipment. <br /> <br />B. Said agreement was amended on December 17,2001, March 17, 2003 and September <br />2, 2003 in order to provide continuous uninterrupted services under said Agreement. <br /> <br />C. The parties hereto now desire to amend the Period of Performance and Payment sections of <br />said Agreement in order to provide continuous uninterrupted services to the City under said Agreement. <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises <br />hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as <br />hereby amended, the parties hereto do hereby agree as follows: <br /> <br />1. Section I, the "Period of Performance" section of said Agreement as amended is hereby amended to <br />extend the period of performance until September 2, 2005. <br /> <br />2. Section 4, the" Payment" section of said Agreement as amended is hereby amended to provide the <br />City will pay total compensation under the terms of said Agreement which shall not exceed <br />$41,000.00. <br /> <br />3. Except as hereinabove modified, the terms and conditions of said Agreement and all Exhibits <br />thereto, remain unchanged and in full force and effect. <br /> <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said <br />Agreement the date and year first above written. <br /> <br />ATTEST <br /> <br /> <br /> <br />¿~ <br /> <br /> <br />ATRICIA E.
