<br />ORDINANCE NO. NS-2671 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA CALLING FOR AND GIVING NOTICE OF <br />A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE <br />CITY OF SANTA ANA ON APRIL 5, 2005 FOR THE <br />SUBMISSION TO THE VOTERS OF A QUESTION <br />RELATING TO ORDINANCE NO NS-2649 APPROVING <br />THE ONE BROADWAY PLAZA DEVELOPMENT. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1: On August 2, 2004, the City Council adopted Ordinance No. NS- <br />2649 establishing Specific Development District 75 (SD-75) and amending elements of <br />the Midtown Specific Plan No.3 (SP-3) to permit development of One Broadway Plaza, <br />a 37-story office tower, along with an 8-story parking garage and related support retail <br />space generally located at the northeast corner of Broadway and 10th Street in the City <br />of Santa Ana. <br /> <br />SECTION 2: On September 1, 2004, a referendum petition regarding Ordinance <br />No. NS-2649 was filed with the Clerk of the Council. On September 27, 2004 the <br />Orange County Registrar of Voters determined that the referendum petition was valid <br />and sufficient to require the City Council to either repeal Ordinance No. NS-2649 or <br />submit it to the voters of the City for approval. <br /> <br />SECTION 3: The City Council, hereby determines that the most appropriate <br />action is to submit the ordinance to the voters, and therefore does order submitted to <br />the voters at the Special Municipal Election the following question: <br /> <br />Yes <br /> <br />Shall Ordinance No. NS-2649, <br />permitting development of One <br />Broadway Plaza, a 37 -story office No <br />building and related parking and <br />retail improvements, be adopted? <br /> <br />SECTION 4: That the proposed complete text of the ordinance submitted to the <br />voters is attached as Exhibit A. <br /> <br />Ordinance No. NS-2671 <br />Page 1 of 4 <br /> <br />11 A-1 <br /> <br />
