<br />ORDINANCE NO. NS-2649 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA REZONING THE PROPERTY LOCATED AT <br />ONE BROADWAY PLAZA FROM MIDTOWN SPECIFIC <br />PLAN NO. 3 (SP-3) TO ONE BROADWAY SPECIFIC <br />DEVELOPMENT DISTRICT (SD-75) (AA NO. 2004-01); <br />AMENDING THE MIDTOWN SPECIFIC PLAN (ZOA NO. <br />2004-02) AND ADOPTING THE ONE BROADWAY <br />SPECIFIC DEVELOPMENT DISTRICT (SD-75) <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana does hereby find, detennine <br />and declare as follows: <br /> <br />A. Applicant is requesting approval of various entitlements in order to construct <br />a thirty-seven (37) story, 493 feet in height, office tower located at One <br />Broadway. <br /> <br />B. On February 23, 2003, the Planning Commission held a duly noticed public <br />hearing, and by a vote of 6:1 (Sinclair opposed) voted to recommend that <br />the City Council: <br /> <br />1. Certify and adopt the Final Environmental Impact Report No. 99-01, <br />the Mitigation Monitoring Program, and the Statement of Overriding <br />Con~iderations. <br /> <br />2. Adopt an ordinance approving the rezoning the property located at <br />One Broadway Plaza from Midtown Specific Plan No.3 (SP-3) to <br />One Broadway Specific Development District (50-75), Amendment <br />Application No. 2004-01. <br /> <br />3. Adopt an ordinance amending to the Midtown Specific Plan (SP-3) <br />(ZOA No. 2004-02). <br /> <br />4. Adopt a resolution amending the General Plan of the City of Santa <br />Ana to increase the Floor Area Ratio to 2.9, to classify streets as <br />Local Commercial Streets, and to modify the Urban Design Element <br />(GPA No. 2004-01). <br /> <br />C. The City Council of the City of Santa Ana held a duly noticed public hearing <br />on the abovesaid actions for One Broadway on March 15, 2004, and at that <br />time considered all testimony, written and oral. After closing this hearing, the <br />City Council directed that a Development Agreement be negotiated. <br /> <br />D. On June 14, 2004, the Planning Commission, held a duly noticed pUblic <br />hearing, and by a vote of 6:1 (Sinclair opposed) voted to recommend that <br />the City Council: <br /> <br />1.
