<br />July 19, 2004 meeting, the City Council also introduced an ordinance <br />rezoning the property (AA No. 2004-01), adopted a resolution amending the <br />City's general plan (GPA No. 2004-01) and a resolution approving Tentative <br />Parcel Map No. 2004-02. This ordinance incorporates by reference, as <br />though fully set forth herein, the resolutions and said Final Environmental <br />Impact Report, Mitigation Monitoring Program, and Statement of Overriding <br />Considerations, and all of their respective findings and conclusions in <br />support of this ordinance. <br /> <br />Section 2. The real property located at One Broadway is hereby reclassified <br />from Midtown Specific Plan No.3 (SP-3) to One Broadway Specific Development <br />District (SD-75). Amended Sectional District Map number 12-5-10, showing the above <br />described change in use district designation, is hereby approved and attached hereto as <br />Exhibit "A" and incorporated by this reference as though fully set forth herein. (AA No. <br />2004-01 ). <br /> <br />Section 3. Midtown Specific Plan No.3 (SP-3) is hereby amended as set forth <br />in Exhibit liB", attached hereto and incorporated as though fully set forth herein. (ZOA <br />2004-02). <br /> <br />Section 4. One Broadway Plaza Specific Development District (SD-75) as set <br />forth in Exhibit "C", attached hereto and incorporated as though fully set forth herein, is <br />approved adopted in its entirety. <br /> <br />Section 5. This ordinance shall not be effective unless and until Resolution <br />No. 2004-021 and Ordinance No. NS-2656 becomes effective. If said ordinance or <br />resolution are for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, or otherwise do not go into effect for any reason, then this <br />ordinance shall be null and void and have no further force and effect. <br /> <br />Section 6. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that <br />it would have adopted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that anyone or more sections, <br />subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br /> <br />ADOPTED this 2nd day of AUQust 2004. <br /> <br />~v3~ <br />~iguel A.
