<br />REQUEST FOR <br />COUNCIL ACTION <br /> <br />tI <br />~ <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />DECEMBER 20, 2004 <br />TITLE: <br /> <br />APPROVED <br /> <br />o As Recommended <br />o As Amended <br />o Ordinance on 151 Reading <br />o Ordinance on 2nd Reading <br />o Implementing Resolution <br />o Set Public Hearing For <br /> <br />ABANDONMENT NO. 04-03-S VACATING A <br />PORTION OF STREET AND SIDEWALK <br />EASEMENT ADJACENT TO 8 FIRST <br /> <br /> <br />7ICAN QY EA~~ <br /> <br />11: ~~ANAGER <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />Adopt a resolution vacating portions of street and a sidewalk easement <br />along south side of 8 First American Way East. <br /> <br />DISCUSSION <br /> <br />First American Title Company of Santa Ana has requested that the City <br />vacate a portion of a street easement and a sidewalk and public utility <br />easement adjacent to the vacant lot at 8 First American Way East <br />(Exhibit 1). When originally dedicated, the easements were intended to <br />provide the City with the appropriate right of way at a planned <br />driveway. However, the driveway was not constructed, and the applicant <br />has reconfigured the site plan to eliminate the proposed driveway. The <br />Planning Commission approved the site plan on September 27, 2004. <br /> <br />The easements are not needed for public purposes and have not been used <br />by the public within the past five years. Private utilities companies, <br />other government agencies, and City Departments have been contacted and <br />reviewed this street vacation request as to potential impacts. No <br />adverse impacts were reported to the Public Works Agency. <br /> <br />There are no City or public owned utilities within the vacated area. <br />However, a fi ve- foot wide sidewalk and public utility easement behind <br />new the right-of-way alignment will be reserved. Drainage and traffic <br />circulation will not be impacted by the vacation. <br /> <br />ENVIRONMENTAL IMPACT <br /> <br />In accordance with the California Environmental Quality Act, the proposed <br />proj ect is exempt from further review. Categorical Exemption ER No. <br />2004-223 will be filed for this report. <br /> <br />12A-1 <br />
