<br />A-2004-197 <br /> <br />INSURANC~ J;, FILE <br />WORK MAY PROCEED <br />UNTiL INSURANCE EXPIRES <br />1- 5 -D5 <br />CLERK OF COUNCIL <br />DATE: 11-.30 -0'1 <br /> <br />THIRD AMENDMENT TO CONSULTANT AGREEMENT <br /> <br />~ : CbA- <br />U-N91lA(~ <br /> <br />THIS THIRD AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on~.e..- J.j , 2004, by and between the Boys and Girls Club of <br />Santa Ana ("Consultant") and the City of Santa Ana ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into Consultant Agreement #A-2001-197, dated October 1,2001, <br />(hereinafter "said Agreement") by which Consultant has operated a "Power Up" <br />Technology Laboratory as part of the Weed and Seed Site I Special Emphasis <br />Initiative. <br /> <br />B. The parties have previously amended said Agreement to increase compensation and <br />extend the term. <br /> <br />C. The parties wish to again increase compensation and extend the term in order to <br />continue the technology lab for an additional one year period. <br /> <br />Wherefore, in consideration of the covenants contained in the Agreement, and subject to <br />all the terms and conditions of the Agreement, except those amended in this Third <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section I, SCOPE OF SERVICES, shall be amended to increase services as set forth <br />in Exhibit A-2, attached hereto and included by this reference. <br /> <br />2. Section 2 a., COMPENSATION, shall be amended to increase the amount available <br />by $8,400.00. Said section shall read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement shall not exceed $34,400.00 during the term ofthis Agreement." <br /> <br />3. Section 3, TERM, shall be amended to read as follows: <br /> <br />"This Agreement shall commence on October 1, 2001 and terminate on September <br />30,2005, unless terminated earlier in accordance with Section 12, below. The term <br />of this Agreement may be extended upon a writing executed by the Executive <br />Director of the Community Development Agency and the City Attorney." <br /> <br />4. Except as hereinabove modified, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
