Mr. Dale Elsberry, Attorney at Law, 517 North Bristol,
representing Mr. G. Nerison, stated that the statutes
and ordinances are not applicable in this case because
the car was in good shape and improvements had been
made on it with new parts and tires, and that the pur-
pose of the ordinance is to abate a nuisance; that the
motor had been removed and that Mr. Nerison was looking
for a place to store it; and he had so informed Officer
Flannery. He further stated that the Notice had nothing
in it to indicate that the vehicle would be destroyed.
He requested Council to consider payment to Mr. Nerison
for damages, in the amount of $3,000, which can be sub-
stantiated by invoices and receipts for parts and improve-
ments on the car. He considered the '58 DeSoto a classic
car.
man Markel, Council denied the appeal. (CA 11.3)
