<br />N- ê)..D(yl-/3C -01 <br /> <br />:NSURANCE@T 0,'1 dLE <br />WORK MAY NOl PROCEED <br />CLERK OF COUNCIL <br />DATE: I) -ð°-o'f <br /> <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />ef~ <br /> <br />nus FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />this -M!:aay of Nð'lM.hfJÝ , 2004, by and between Demsey, Filliger & <br />Associates, LLC ("Consultant") and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into Agreement No. N-2004-130, dated August19, 2004, <br />(hereinafter "said Agreement") by which Consultant has provided actuarial consulting <br />services. <br /> <br />B. The City has requested additional actuarial scenarios be included in the study. <br /> <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase the Scope of Services and Compensation to pay for the increased services. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />I. Section I, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with a <br />new Section I to read as follows: <br /> <br />"Consultant shall perform an actuarial valuation of the retiree health subsidy plan <br />(Fund 84) for the Firemen's Benevolent Association (FBA) employees of the City of <br />Santa Ana. Said valuation shall include all alternative scenarios requested by City. <br />Consultant will compile a report of findings regarding the study and the outcomes <br />using the various scenarios." <br /> <br />2. Section 2, COMPENSATION, shall be amended to increase compensation by Two <br />Thousand Five Hundred Dollars ($2,500.00). The total payment for Consultant's <br />services shall not exceed Seven Thousand Five Hundred Dollars ($7,500.00) during <br />the term of said Agreement. <br /> <br />3.
