INSURANCE ON FILE WORK MAY PROCEED UNTIL INSURANCE EXPIRES la -30,-o4 CLERK OF COUNCIL DATE: 9l -3v —O`l FIRST AMENDMENT TO CONSULTANT AGREEMENT A-2004-240 C = PBA �rzabLS THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into this 15* day of November, 2004, by and between John Kaliski, AIA, dba Urban Studio ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: A. The parties entered into Agreement N-2003-155, dated September 1, 2003, (hereinafter "said Agreement") by which Consultant has provided architecture and urban design services. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend said Agreement for an additional one-year period and to increase compensation to pay for services during the extended term. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the following: "Consultant shall provide architectural and urban design services as requested by the Santa Ana Planning and Building Agency, as set forth in Exhibit A-1, attached to this Amendment to Agreement." 2. Section 2, COMPENSATION, shall be amended in its entirety to read as follows: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A -a. The total sum to be expended under said Agreement shall not exceed $60,000.00 during the term of said Agreement." 3. Section 3, TERM, shall be amended to extend the term for an additional one-year period, through December 31, 2005. 4. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect. FIA H
