C-95-990 <br /> <br />3 <br /> <br />BETWEEN <br />ORANGE COUNTY TRANSPORTATION AUTHORITY <br /> <br />4 <br /> <br />5 <br /> <br />AND <br /> <br />6 <br /> <br />CITY OF SANTA ANA '--'. <br />THIS AMENDMENT NO.9 is made and entered into this 1:J:L day of ~ C~\ I ~ <br /> <br />7 <br /> <br />8 <br /> <br />2004, by and between the Orange County Transportation Authority, a public corporation of the State of <br /> <br />9 <br /> <br />California (hereinafter referred to as "AUTHORITY"), and City of Santa Ana, a municipal corporation <br /> <br />10 <br /> <br />(hereinafter referred to as "AGENCY"). <br /> <br />11 <br /> <br />WITNESSETH: <br /> <br />12 <br /> <br />WHEREAS, by Agreement No. C-95-990 dated August 18, 1995, as last changed by <br />Amendment NO.8 dated July 27, 2004, AUTHORITY and AGENCY entered into an Agreement which <br /> <br />13 <br /> <br />14 <br /> <br />determined that AGENCY was eligible to receive funding under the Combined Transportation Funding <br /> <br /> <br />Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian Facilities <br /> <br />15 <br /> <br />16 <br /> <br />Program; and <br /> <br />17 <br /> <br />WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be <br /> <br />18 <br /> <br />updated as required; and <br />WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A; <br /> <br />19 <br /> <br />20 <br /> <br />NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as <br /> <br />21 <br /> <br />follows: <br /> <br />22 <br /> <br />Amend Exhibit A. "Combined Transportation Funding Programs (CTFP) Allocations", to delete <br /> <br />23 <br /> <br />the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding <br /> <br />24 <br /> <br />Programs (CTFP) Allocations", dated June 28, 2004, included in this Amendment as Attachment NO.1 <br /> <br />25 <br /> <br />which is incorporated into and made a part of the Agreement. <br /> <br />26 <br /> <br />I <br /> <br />YC:CF <br />L:\CAMM\CL RICAL\CLERICAL\WORDPROC\AGREE\AMEND\AM95990.DQC <br /> <br />Page 1 of 2 <br />
