<br />REQUEST FOR <br />COUNCIL ACTION <br /> <br />~ <br />~ <br /> <br />~ <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />FEBRUARY 7, 2005 <br />TITLE: <br />VARIANCE NO. 2004-07 TO PROVIDE <br />EXCEPTION FROM VARIOUS PROVISIONS <br />OF THE SIGN CODE FOR ORIGINAL <br />MIKE'S RESTAURANT AT 100 SOUTH MAIN <br />STREET - CARIBOU INDUSTRIES, <br />APPLICANT <br /> <br />Ç) «<fila," <br /> <br />C Y MANAGER <br /> <br />APPROVED <br />0 As Recommended <br />0 As Amended <br />0 Ordinance on 1st Reading <br />0 Ordinance on 2nd Reading <br />0 Implementing Resolution <br />0 Set Public Hearing For <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />1. <br /> <br />Adopt a resolution denying Variance No. 2004-07 (AI, A2, A3) for Sign <br />No.1 to disallow a sign not located on a primary elevation, <br />installed higher than 20 feet on building and containing slogans; <br />(G1, G2, G3) for Sign No.8 to disallow a sign in excess of one per <br />building elevation, to disallow a sign containing slogans and <br />designed as a prohibited cabinet sign; and (I) for Sign No. 10 to <br />disallow a sign above the roof line. <br /> <br />2. <br /> <br />Adopt a resolution approving Variance No. 2004-07 (B) to allow one <br />changeable copy sign for Sign Nos. 2 and 3; (C1, C2, C3) for Sign No. <br />4 to allow a sign exceeding maximum size of 50 square feet, to allow <br />the painted wall sign above the ground level of the building and to <br />allow a sign containing a slogan; (D1) to allow the projecting sign <br />to extend more than four feet, (D2) to allow animated lights and (D3) <br />to allow a sign exceeding maximum of five words for Sign No.5; (E) <br />for Sign No.6 to allow a cabinet sign; (F) for Sign No.7 to allow a <br />sign containing a slogan; and (H) for Sign No.9 to allow a monument <br />sign containing in excess of the allowed eight items of information <br />as conditioned. <br /> <br />DISCUSSION <br /> <br />On January 18, 2005, the City Council held a public hearing on the sign <br />variances for Original Mike's restaurant. After extensive discussions of <br />the issues, the City Council directed staff to prepare findings and <br />conditions in support of the applicant's request to allow the "good <br />cookin, good livin, good eat in" slogan on four signs. As a result, the <br />findings and conditions of approval have been revised to address the <br />approval of the slogan. <br /> <br />55C-1 <br />
