<br />RESOLUTION NO. 2005-016 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA CERTIFYING AND APPROVING THE <br />ENVIRONMENTAL IMPACT REPORT, APPROVING A <br />MITIGATION MONITORING PROGRAM, AND ADOPTING <br />CERTAIN FACTS, FINDINGS AND A STATEMENT OF <br />OVERRIDING CONSIDERATIONS FOR THE PROPERTY <br />LOCATED AT 2725 NORTH MAIN STREET <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />AS FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. Applicant is requesting approval of various entitlements in order to construct <br />the City Place project, which is a mixed use development with 57,700 <br />square feet of commercial space (being a mix of sit-down restaurants, retail <br />and market); 73 for-sale, live-work lofts and 168 for-sale townhouses for the <br />approximately 17.7 acres located at the northeast corner of Main Street and <br />Memory Lane, 2775 North Main Street. <br /> <br />B. On December 13, 2004, the Planning Commission held a duly noticed public <br />hearing, and by a vote of 6:1 (Sinclair opposed) voted to recommend that <br />the City Council: <br /> <br />1. Certify and adopt the Final Environmental Impact Report No. <br />2004-01, the Mitigation Monitoring Program, and the Statement of <br />Overriding Considerations. <br /> <br />2. Adopt an ordinance amending to the Specific Development Plan <br />No. 59 (SD-59) (lOA No. 2004-06). <br /> <br />3. Adopt a resolution approving a conditional use permit for 73 for-sale, <br />live-work units (CUP No. 2004-28). <br /> <br />4. Adopt an ordinance approving an amended and restated <br />Development Agreement (DA No. 2004-04). <br /> <br />5. Adopt a resolution approving Vesting Tentative Map No. 2004-06. <br /> <br />6. Adopt a resolution approving <br /> <br />C. The City Council of the City of Santa Ana held a duly noticed public hearing <br />on the abovesaid actions for City Place on February 7, 2005, and at that <br />time considered all testimony, written and oral. <br /> <br />D. Due to the size of the project and the impacts to the environment, a Draft <br />Environmental Impact Report (EIR) was prepared for this project.
