<br />PUBLIC HEARINGS <br /> <br />PUBLIC HEARINGS <br /> <br />75.A. <br /> <br />PUBLIC HEARING - REGARDING THE 2005 DOWNTOWN SANTA ANA <br />BUSINESS IMPROVEMENT AREA (BID) ANNUAL ASSESSMENT <br /> <br />Legal notice published in the Orange County Reporter on January 7,2005. <br /> <br />Mayor Pulido declared a potential conflict of interest because of the <br />proximity of his business to the Downtown Santa Ana Business <br />Improvement Area and left the room; Mayor Pro Tern Bist assumed the <br />Chair. <br /> <br />Staff presentation by Pat Whitaker, Executive Director, Community <br />Development Agency <br /> <br />Written Communication: Protests were received from the following business <br />establishments in the Downtown Santa Ana Business Improvement Area: <br />Castillo's Professional Services/Travel; Frutas Acapulco; Frutas La Placita <br />(2); Genises Bridal shop; Holiday Travel & Tours (2); Iberoamerica Travel; Mi <br />Moda, Inc.; Mo's Perfume & Cosmetics Plus; Pacific Coast Tax Service; <br />Servicios Hispanos; Truth & Advertising; Urban Fashion; Valencia Jewelry <br /> <br />Dennis Winston, Attorney for Elsa Gomez addressed <br />opposition to the assessment; Elsa Gomez addressed <br />opposition to the process as well as the assessment <br /> <br />the Council in <br />the Council in <br /> <br />Bob Stewart asked the Council to move forward with the assessment at <br />100%, and asked that the timetable for definition of the boundaries of two <br />separate business improvement districts be set for 120 days <br /> <br />The Chair announced that this was the final notice for individuals to submit a <br />written protest to the Clerk of the Council; there being no further protests filed <br />with the Clerk, the public hearing was closed. <br /> <br />The City Attorney recommended that the Council make a finding that all <br />petitions filed by Elsa Gomez on December 20, 2004 are not valid protests <br />for the purpose of tonight's hearing. He further announced that staff had <br />reviewed the protests received prior to the close of the public hearing and <br />that there were fifteen protests submitted. A percentage of the overall <br />business license tax was computed for each business to determine a <br />weighted amount for each business. The results of the petitions received <br />and the respective weighted value equals 2.6769% of the BID area. The City <br />Attorney informed the Council that a majority protest was not received and <br />the Council could approve the resolution levying an Assessment for the <br />Downtown Santa Ana Business Improvement Area for the Year 2005 <br /> <br />CITY COUNCIL MINUTES <br /> <br />29 <br /> <br />JANUARY 18, 2005 <br />
