<br />RESOLUTION NO. 2005-004 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA LEVYING AN ASSESSMENT FOR THE <br />DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT <br />AREA FOR THE YEAR 2005. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />E. <br /> <br />A. <br /> <br />On February 6, 1984, the City Council, by Ordinance No. NS-1715, <br />established the Downtown Santa Ana Business Improvement Area <br />pursuant to California Streets and Highways Code Sections 36500-36551 <br />(the "BID Law"). <br /> <br />B. <br /> <br />On January 3, 2005, the City Council received the 2004 Annual Report for <br />the Downtown Santa Ana Business Improvement Area (the "Report"). <br /> <br />C. <br /> <br />On January 3, 2005, the City Council adopted Resolution 2005-093 <br />approving, as amended, the Report and setting a public hearing for <br />January 18, 2005 at which protests could be made to the proposed levy of <br />the 2005 annual assessment for the Downtown Santa Ana Business <br />Improvement Area (the "Annual Assessment"). <br /> <br />D. <br /> <br />On January 18, 2005, at the time and place called for in Resolution 2005- <br />093, the City Council conducted a duly noticed public hearing at which <br />written and oral protests to the proposed Annual Assessment were made <br />and considered. <br /> <br />Qualifying written protests constituting a majority of the owners of the <br />businesses paying the Annual Assessment were not received at or before <br />the public hearing. <br /> <br />Section 3. The Report, as modified, is hereby confirmed, and the levy of an <br />assessment for the calendar year 2005 in accordance with Attachment B of the Report, <br />a copy of which is attached hereto and incorporated herein by reference, is hereby <br />approved. <br /> <br />ADOPTED this 18!!l_day of Januarv. 2005. <br /> <br />Resolution 2005-004 <br />Page 1 of 72 <br />
