RESOLUTION NO. 2005-004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA LEVYING AN ASSESSMENT FOR THE DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT AREA FOR THE YEAR 2005. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: E. A. On February 6, 1984, the City Council, by Ordinance No. NS-1715, established the Downtown Santa Ana Business Improvement Area pursuant to California Streets and Highways Code Sections 36500-36551 (the "BID Law"). B. On January 3, 2005, the City Council received the 2004 Annual Report for the Downtown Santa Ana Business Improvement Area (the "Report"). C. On January 3, 2005, the City Council adopted Resolution 2005-093 approving, as amended, the Report and setting a public hearing for January 18, 2005 at which protests could be made to the proposed levy of the 2005 annual assessment for the Downtown Santa Ana Business Improvement Area (the "Annual Assessment"). D. On January 18, 2005, at the time and place called for in Resolution 2005- 093, the City Council conducted a duly noticed public hearing at which written and oral protests to the proposed Annual Assessment were made and considered. Qualifying written protests constituting a majority of the owners of the businesses paying the Annual Assessment were not received at or before the public hearing. Section 3. The Report, as modified, is hereby confirmed, and the levy of an assessment for the calendar year 2005 in accordance with Attachment B of the Report, a copy of which is attached hereto and incorporated herein by reference, is hereby approved.
