The Negative Declaration was approved and filed and the <br />following Resolution No. 75-158 was adopted, on the motion <br />of Councilman Brandt, seconded by Councilman Bricken and <br />carried (4-3) with Councilmen Ward, Evans and Yamamoto <br />dissenting: <br /> <br />RESOLUTION NO. 75-158 - A RESOLUTION OF THE <br />CITY COUNCIL OF THE CITY OF SANTA ANA AFFIRM- <br />ING THE ACTION OF THE PLANNING COMMISSION ON <br />VARIANCE APPLICATION NO. 75-52, APPROVING SAID <br />VARIANCE APPLICATION FILED BY JAMES LUKENS. <br /> <br />CA 13.3a <br /> <br />PUBLIC HEARING - APPEAL NO. 358 Mayor Garthe announced <br />EIR 74-6 - VARIANCE APPLICATION that this was the time <br />75-50 and place for the public <br /> hearing on Appeal No. <br />358, filed by Lee M. Kearney, President of Citizens for <br />Fair Housing Association, opposing the Planning Commission <br />approval of Variance Application 75-50 and its certification <br />and adoption of Envirnmental Impact Report 74-6 as the <br />City's Final Environmental Impact Report for the Lake Dianne <br />Project (Variance 75-50). The purpose of the variance is <br />to allow parking and portions of two-story apartment build- <br />ings in the Ri District and two-story apartment buildings <br />within 150' of property zoned Ri on Assessor's Parcel No. <br />62-371-1 located at Dianne and Fruit Streets. The variance <br />application was filed by Parkcenter Corporation. <br /> <br />Mr. William Daugherty, Senior Planner, stated that the subject <br />property has a combination of zones; that it is zoned R4 <br />with a 100-foot deep buffer strip abutting Fruit Street; <br />that the EIR addressed itself to an apartment complex of <br />314 units with a proposed density of 25.8 units per acre. <br /> <br />Mr. Daugherty stated further that Mrs. Kearney's written <br />request to the Planning Commission for a continuance on the <br />variance to allow her to further review the matter and to <br />recover from an illness was denied by the Planning Commission <br />at its October 14 meeting. <br /> <br />Following Council discussion, Councilman Bricken moved to <br />refer the EIR and VA 75-50 back to the Planning Commission <br />for a re-hearing of the public testimony at a time when both <br />the applicant and the people in the community can present <br />their case and to authorize the return of the $125 appeal <br />filing fee to the appellant. The motion was seconded by <br />Councilman Ortiz, and unanimously (7-0) carried. <br /> <br />Prior to the vote on the motion, Mr. Robert Davis, So. <br />Brookhollow Drive, representing Parkcenter Corporation, <br />stated that he did not object to the motion in view of <br />Council's concern. <br /> <br />CA 13.3 <br /> <br />PUBLIC HEARING - NEGATIVE Mayor Garthe announced <br />DECLARATION AND AMENDMENT that this was the time <br />APPLICATION 730 and place for the public <br /> hearing of the Negative <br />Declaration and Amendment Application 730 initiated by the <br />Planning Commission to rezone property from Ri (Single Family <br />Residence) District to the O (Open Space Land) District, and <br />amending sectional district map 6-5-9; that the property is <br /> <br />CITY COUNCIL MINUTES <br /> <br />468 NOVEMBER 3, 1975 <br /> <br /> <br />
