Planning Director Charles Zimmerman referred to the Planning Commission report dated March 31, 1977, and indicated that there were several surrounding properties that indicated that the area could support an R3 zone; that the Planning Commis- sion unanimously recommended approval of the rezoning following a public hearing held March 28, 1977. Howard G. Jacobs stated that he concurred with the findings of the Staff and Planning Commission. There were no written communications and no other speakers; the Vice Mayor closed the public hearing. ORDINANCE NO. NS-1367 - AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 765 FILED BY HOWARD G. JACOBS REZONING PROPERTY FROM THE C1 (COMMUNITY COMMERCIAL) DISTRICT TO THE R3 (MEDIUM DENSITY MULTIPLE FAMILY RESIDENTIAL) DISTRICT AND AMENDING SECTIONAL DISTRICT MAP 4-5-9 was placed on first reading, and the Negative Declaration was approved and filed, on the unanimously carried 6:0 motion of Councilman Bricken, seconded by Councilman Garthe. CA 10 ORANGE COUNTY LEAGUE OF CITIES After Council discussion BUDGET - 2~ PER CAPITA ASSESSMENT and on the motion of APPROVED Councilman Yamamoto, seconded by Vice Mayor Ward, and carried 5:1, with Councilman Ortiz dissenting, approval was given to an Orange County Division Budget pro- posed by the Executive Director based upon a two cent per capita assessment, with the assurance that this Council would review and consider a somewhat higher budget if one is pro- posed by the Director. A prior motion made by Councilman Brandt, seconded by Council- man Garthe, to approve the proposed budget based on a two cent per capita assessment with the understanding that a larger budget could be negotiated upwards, but not to exceed a 25% increase, failed to carry on a 3:3 vote, with Councilmen Yamamoto, Ortiz and Bricken dissenting. Councilman Bricken stated that he could support a budget reflect- ing a 5% increase in assessment. CA 148.1 ORAL COMMUNICATION Upon the recommendation CLAIM AGAINST CITY - REYES of the City Attorney, ATTORNEY AUTHORIZED Keith Gow, on the motion of Councilman Garthe, seconded by Councilman Yamamoto, the City Attorney was author- ized to settle the claim filed by. Michael O. Reyes for the sum of $111.00, on a 5:1 vote, with Councilman Bricken dissent- ing. CA 65;7b ADJOURNMENT At 9:35 P.M.
