Wendell Bril, Building Safety Director, reviewed the chronology <br />of significant events contained in his report to Council dated <br />June 15, 1977; he stated that progress had been made on two <br />of the houses, but that there had not been much success with <br />723 South Hesperian and that the owner had been notified on <br />May 23, 1977 that he had 15 days to begin the work; he stated <br />that to date no work had been done. <br /> <br />Speakers seeking prompt action to abate the nuisance were: <br /> <br />Margaret Sandoval, 715 South Hesperian <br />Miguel Gomez, 806 South Hesperian <br />Priscilla Camacho, 814 South Hesperian <br />Reverend Tommy Anderson, First Baptist <br />Rick Erhart, McFadden & Center <br /> <br />Church <br /> <br />Action taken by the Council was proposed by the City Attorney <br />as the quickest solution to the problem. <br /> <br />Councilman Brandt reminded the neighbors that it is their <br />responsibility to assist the City to reduce the criminal <br />activity in the area by reporting persons seen defacing private <br />property. CA 87 <br /> <br />PUBLIC HEARING - APPEAL NO. 376 Mayor Evans announced <br />VA 77-11 & NEGATIVE DECLARATION that this was the time <br />MARY F. BUTTS - GRANTED and place for the public <br /> hearing of Negative <br />Declaration and Appeal No. 376, filed by James A. and Mary F. <br />Butts, of the Planning Commission denial of Variance 77-11, to <br />allow self-service gas pumps on an existing market site in the <br />C5 District at 2151 East Santa Clara Avenue. <br /> <br />Planning Director Charles Zimmerman reviewed the Planning Commis- <br />sion Finding of Fact which concluded, in part, that no special <br />circumstances existed on the subject property to justify grant- <br />ing a variance, and that the property enjoys all the property <br />rights afforded under the C5 zoning. The Director further <br />stated that the site is poorly designed for the proposed use <br />and that there are other facilities in the area to provide the <br />proposed service. <br /> <br />Proponent James A. Butts, 9401 Tanager Avenue, Fountain Valley, <br />stated gasoline pumps are helpful to a convenience market; that <br />they will utilize existing land space and make a small profit; <br />that the lot is well suited to the addition of a pump island <br />by reason of the size and location of the access driveways; that <br />it will provide a service to his customers; that the CS zone <br />allows markets and service stations, and he wants to combine <br />the services because there is no conflict; that the proposed <br />use will not be detrimental to the neighborhood; and that <br />denial of the variance hurts his rights as a property owner. <br /> <br />There were no other proponents or opponents or written communica- <br />tions, and the Mayor.closed the public hearing. <br /> <br />Council approved and filed the Negative Declaration and directed <br />the City Attorney to prepare a resolution granting Appeal No. <br />576, approving VA 77-11 and overruling the Planning Commission <br />denial of the Variance, on motion of Councilman Brandt, seconded <br />by Councilman Ortiz, and carried 4:1, with Councilman Ward <br />dissenting.
