ORDINANCE NO. NS-1410 - AN ORDINANCE OF THE CITY OF SANTA <br />ANA ADOPTING SPECIFIC PLAN FOR STREET ALIGNMENT NO. 49 AND <br />ADDING SECTION 41-748 TO THE SANTA ANA MUNICIPAL CODE TO <br />ESTABLISH STREET ALIGNMENT FOR COLLEGE AVENUE FROM SEVEN- <br />TEENTH STREET TO A POINT 354.16' NORTH. <br /> <br />The Mayor and Clerk was authorized to execute a Deed with Cash <br />and Escrow to purchase property on the north side of Seventeenth <br />Street east of College for street purposes from Donald Sher for <br />$185,000 on the motion of Councilman Brandt, seconded by Council- <br />man Ward, and carried 6:1, with Councilman Yamamotd dissenting. <br /> CA 29.7 <br /> CA 155 <br /> <br />ORAL COMMUNICATION Councilman Yamamoto recom- <br />APPOINTMENT TO PERSONNEL BOARD mended the appointment of <br />JACQUELINE D. SPANLEY APPOINTED Jacqueline Spanley from <br /> Ward 7 to fill the vacancy <br />on the Personnel Board for a term ending June 30, 1979, replac- <br />ing Pauline Lockwood. The appointment was made on the motion <br />of Councilman Yamamoto, seconded by Councilman Garthe, and <br />carried 6:1, with Councilman Ortiz dissenting. Councilman <br />Ortiz stated that his objection related only to the fact that <br />Mrs. Spanley was an employee of a bureaucracy. CA 50.8 <br /> <br />ORAL COMMUNICATION <br />REVIEW OF PERFORMANCE - CITY <br />ATTORNEY - SET FOR APRIL 25 <br /> <br />at 4:00 P.M. in Executive Session. <br /> <br />The performance review of <br />the City Attorney intended <br />for this meeting was post- <br />poned to April 25, 1978 <br /> <br />ORAL COMMUNICATION City Attorney Keith Gow <br />LEGAL ACTION - MURAl FARMS stated that it would be <br />APPROVED necessary to obtain Council <br /> approval to commence legal <br />action against Murai Farms, to resolve the matter of use and <br />occupancy of City lands intended for Centennial Park. Assistant <br />City Attorney Edward Cooper stated that the License Agreement <br />between the City and Murai Farms for use of the property expired <br />December 13, 1977; that Mural Farms had requested a restraining <br />order to prevent the City from utilizing its property until a <br />November strawberry crop was harvested, but that it was not <br />granted; that a Federal representative contacted the City and <br />stated that if Murai Farms pays $65,839 damages, they can be <br />allowed to retain the use of the property through June 30, 1978; <br />the City Attorney's office drafted a contract, but if it cannot <br />be negotiated, legal action would be in order to recover the <br />property. <br /> <br />The recommended consent was given on the unanimously carried 7:0 <br />motion of Councilman Bricken, seconded by Councilman Ward. <br /> CA 139 <br /> <br />ADJOURNMENT <br /> <br /> At 8:17 P.M.
