<br />. <br /> <br />WHEREAS, the Agency has used Housing Funds to purchase <br />certain real property located at 1115-1117 North Bush street (the <br />~Property"), which is located outside the Redevelopment Project <br />area; and <br /> <br />WHEREAS, the Agency proposes to sell the Property to Shelter <br />for the Homeless, A California nonprofit corporation, dab <br />American Lodging, for rehabilitation and use in accordance with a <br />proposed Disposition and Development Agreement (the ~DDA"); and <br /> <br />WHEREAS, pursuant to the DDA, American Lodging will use the <br />Property exclusively as a small housing project, as defined in <br />section 33013 of the Community Redevelopment LaW, consisting of <br />two units of affordable rental housing for very-low-income <br />families; and <br /> <br />WHEREAS, the use of Housing Funds as provided in the DDA is <br />of benefit to the Redevelopment Project; and <br /> <br />WHEREAS, the development of the Parcels pursuant to the <br />Agreement is an activity that is categorically exempt from the <br />California Environmental Quality Act (Class 3, CEQA Guidelines <br />/)15303); and <br /> <br />. <br /> <br />WHEREAS, THE Agency has duly considered all of the terms and <br />conditions of the proposed Agreement, and believes that the <br />proposed Agreement is in the best interests of the city and the <br />health, safety, morals and welfare of its residents, and in <br />accord with the public purposes and provisions of applicable <br />state and local laws and requirements; and <br /> <br />WHEREAS, this Agency has held a public hearing on the <br />proposed project and the Agreement as required for a small <br />housing project by Section 33433(c) of the Community <br />Redevelopment Law, after having duly provided notice of such <br />public hearing in accordance with state law. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Community <br />Redevelopment Agency of the City of Santa Ana as follows: <br /> <br />1. <br /> <br />The Agency recognizes that it has received and heard <br />all oral and written objections to the proposed <br />Agreement, to the proposed financing of the Project <br />pursuant to the proposed Agreement, and to other <br />matters pertaining to this transactions, and that all <br />such oral and written objections are hereby overruled. <br /> <br />2. <br /> <br />The Agency hereby finds and determines that the <br />Recitals set forth above are true and correct. <br /> <br />3. <br /> <br />The Agency hereby finds and determines that the sale of <br />the Property in accordance with the Agreement will <br />provide housing for low- or moderate-income persons. <br /> <br />. <br /> <br />2 <br />
