<br />I <br /> <br />8 <br /> <br />I <br /> <br />RESOLUTION NO. 98-2 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA APPROVING A <br />TERMINATION AGREEMENT AND A COOPERATION <br />AGREEMENT RELATED TO THE MACARTHUR PLACE <br />PROJECT, AND MAKING CERTAIN ENVIRONMENTAL <br />FINDINS RELATED THERETO. <br /> <br />WHEREAS, the Community Redevelopment Agency of the City of <br />Santa Ana (hereinafter referred to as the" Agency") is engaged in <br />activities necessary to execute and implement the Redevelopment <br />Plan for the South Main Redevelopment Project Area (the, "Project <br />Area"); and, <br /> <br />WHEREAS, on or about April 19, 1988 the Agency entered into a <br />certain Disposition and Development Agreement regarding a ~ 62 <br />acre portion of the Project Area commonly known as MacArthur Place <br />(the "DDA"); and, <br /> <br />WHEREAS, the Agency has received a request to terminate the <br />DDA as to a ~ 40 acre portion of MacArthur Place (the "Project"), <br />which request the Agency is willing to honor; and, <br /> <br />WHEREAS, the Agency desires to assist the City of Santa Ana <br />in providing for the costs of certain public improvements to serve <br />the Project; and, <br /> <br />WHEREAS, the Agency has reviewed the applicable environmental <br />documents related to the Project. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY <br />REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA, AS FOLLOWS: <br /> <br />1. That certain Termination Agreement between the Agency <br />and MacArthur Place, LLC, on file with the Secretary of the <br />Agency, is hereby approved, and the Chairman of the Agency is <br />hereby authorized and directed to execute said agreement on behalf <br />of the Agency, with such non-substantive changes as may be <br />recommended by Agency Counsel. <br /> <br />2. That certain Cooperation Agreement between the Agency <br />and the City of Santa Ana is hereby approved, and the Chairman of <br />the Agency is hereby authorized and directed to execute said <br />agreement on behalf of the Agency, with such non-substantive <br />changes as may be recommended by Agency Counsel. <br /> <br />3. Those certain environmental findings identified as <br />"Environmental Findings, City of Santa Ana, The First American <br />Financial Corporation Project at MacArthur Place, ER 97-126, Case <br />No. DP 97-062", which are on file with the Secretary of the <br /> <br />1 <br />
