CEQA Compliance, Pursuant to the provisions of the California Environmental <br />Quality Act (CEQA), the City of Santa Ana has prepared, approved and certified a negative <br />declaration (Environmental Review No. 00-151) for this Project. As a responsible agency for <br />pUlpOses of CEQA, the Agency has considered this negative declaration and accepts it pursuant <br />to State CEQA Guidelines § 15096. The Executive Director is directed to prepare and file an <br />appropriate Notice of Determination with the County Clerk of the County of Orange in the <br />manner required by law, <br /> <br />Pursuant to Title XN, California Code of Regulations ("CCR") § 735.5(c)(I), the <br />Agency has determined that, after considering the record as a whole, there is no evidence that the <br />proposed project will have the potential for any adverse effect on wildlife resources or the <br />ecological habitat upon which wildlife resources depend. The proposed project exists in an urban <br />environment characterized by paved concrete, roadways, surrounding buildings and human <br />activity. Therefore, pursuant to Fish and Game Code § 711.2 and Title XN, CCR § 735.5(a)(3), <br />the payment ofFish and Game Department filing fees is not required in conjunction with this <br />project <br /> <br />3, Approval ofOPA. The Agency Counsel is directed to prepare and the Executive <br />Director and Chair are authorized to execute an Owner Participation Agreement with Imperial <br />Hotel Group, LLC, pursuant to Health & Safety Code § 33380. <br /> <br />4. Acceptance of Loan. The Agency Counsel is directed to prepare, and the Chair and <br />Executive Director are authorized to approve appropriate loan documents pursuant to City of <br />Santa Ana Resolution No, 2000-~, <br />
