<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Mr. Scott then gave a brief presentation of his site plans and <br />architectural drawings, discussing his designs. The plans call <br />for a multi-story, U-shaped building and an open area plaza facing <br />the Courthouse. Structure is to be masonry, earth tone materials. <br />The initial plan is for one major retail level, residential, and <br />several stories of commercial office space. A mezzanine retail <br />area is being considered to take advantage of the attractive court- <br />yard view. Also contemplated is a structured parking area, hope- <br />fully at the South area. During the six month exclusive right to <br />negotiate, this parking plan will be developed. <br /> <br />He continued by informing the Agency that his preliminary study <br />takes into consideration the interests of the Presbyterian Church, <br />Masonic lot and the neighboring property owners. He concluded <br />by stating that past discussions with the Commission and Staff <br />members offered views which are incorporated in the preliminary <br />study. <br /> <br />In response to Mr. Evans' query as to the project's financial status, <br />the Executive Director reported that this aspect is currently being <br />investigated, but all evidence indicates that Mr. Scott is finan- <br />cially capable to develop what he proposes. <br /> <br />Mr. Evans questioned the idea of authorizing a six month exclusive <br />right to negotiate to Mr. Scott, thus tying up this particular <br />area, thereby preventing further development proposals from other <br />interested parties. <br /> <br />The Executive Director stated that it is always difficult to deter- <br />mine finally a developer's capabilities¡ what one developer can <br />develop within a certain budget allowance, another cannot. Currently, <br />an analysis will be made during the six months to ascertain whether <br />the developer has the financial capabilities to handle this project. <br /> <br />Before a motion was acted upon, Mr. Yamamoto informed the Agency <br />that he could not vote in favor of granting a six month exclusive <br />right to Mr. Scott. He further stated that in view of the fact <br />Mr. Scott had gone to the expense of retaining the services of <br />an architect prior to being granted this right to negotiate, it <br />appeared that previous assurances of such award were promised to <br />the developer. <br /> <br />The Executive Director explained that this particular site, because <br />of the location near the Old Courthouse, was developed more slowly <br />and cautiously than others have been. He stated that this proposal <br />has been previously brought before the Commission, who expressed <br />concern for the site. In addition, Staff has had numerous meetings <br />with Mr. Scott prior to bringing this matter before the Agency. <br /> <br />Mr. Evans made a motion to grant a six month exclusive right to <br />negotiate to Mr. E. Walter Scott for the development of the prop- <br />erty bounded by Broadway, Sycamore, Fifth and Santa Ana Boulevard. <br />The motion was seconded by Mr. Garthe, and carried 6:0 unanimously. <br /> <br />AMERICAN NATIONAL PROPERTIES - OWNER PARTICIPATION AGREEMENT <br /> <br />A motion was made by Mr. Evans, seconded by Mr. Garthe, and carried <br />6:0 unanimously to authorize Staff to establish a public hearing <br />for January 15,1979, as legally required prior to entering into <br />an Owner Participation Agreement to convey land to an owner/developer. <br /> <br />KEISER DEVELOPMENT COMPANY - OWNER PARTICIPATION AGREEMENT <br /> <br />A motion was made by Mr. Evans, seconded by Mr. Garthe, and carried <br />6:0 unanimously to authorize Staff to establish a public hearing <br />for January 15,1979, as legally required prior to entering into <br />an Owner Participation Agreement to convey land to an owner/developer. <br /> <br />2. <br />
