VAN INGEN, ET AL. <br /> <br />SCOTT COMMERCIAL REHABILITATION PARTICIPATION AGREEMENT AMENDMENT <br /> <br />It was moved by Mr. Bricken, seconded by Mr. Griset and carried by a <br />vote of 6:1 (Mr. Markel casting the "NO" vote) that the Agency adopt <br />Resolution 80-82: A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY <br />OF THE CITY OF SANTA ANA AUTHORIZING THE CHAIRMAN TO EXECUTE AN <br />AMENDMENT TO COMMERCIAL REHABILITATION PARTICIPATION AGREEMENT BETWEEN <br />THE AGENCY AND E. WALTER SCOTT. <br /> <br />REVOLVING LOAN PROGRAM - THE JACKMAN BUILDING <br /> <br />It was moved by Mr. Luxembourger, seconded by Mr. Griset and carried <br />by a vote of 6:1 (Mr. Markel casting the "NO" vote) that the Agency <br />adopt Resolution 80-83: A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA AUTHORIZING THE CHAIRMAN OF THE AGENCY <br />. TO EXECUTE AN AMENDMENT TO THE REVOLVING LOAN AGREEMENT BETWEEN THE <br />AGENCY AND SYLVIA JACKMAN, ET AL. <br /> <br />EXECUTIVE SESSION <br /> <br />At 1:50 P.M., the Chairman recessed the Agency meeting to an Executive <br />Session to discuss legal matters. At 2:05 P.M., the meeting was <br />reconvened with the same members present. <br /> <br />It was moved by Mr. Bricken, seconded by Mr. Serrato and carried by a <br />vote of 6:1 (Mr. Markel casting the "NO" vote) that the Agency <br />authorize execution of an amendment (dated 7/18/80) to the Disposition <br />and Development Agreement with Santora Partners. <br /> <br />It was moved by Mr. Yamamoto, seconded by Mr. Luxembourger and carried <br />by a vote of 6:1 (Mr. Markel casting the "NO" vote) that the Agency <br />authorize the Agency Legal Counsel to settle suit on eminent domain <br />entitled Community Redevelopment Agency vs. Fuss, Orange County <br />Superior Court Case No. 31-42-53 and to purchase the property therein <br />described, for the sum of $74,000, plus legal interest and costs, for <br />a total amount of $75,165.17. <br /> <br />4IÞ It was moved by Mr. Luxembourger, seconded by Mr. Bricken that the <br />Agency authorize the Agency Legal Counsel to take all necessary <br />measures, including filing of an action in the Superior Court for <br />specific enforcement against Inge Endres to require compliance with <br />that certain agreement to purchase real property executed on May 13, <br />1980. <br /> <br />PUBLIC HEARING TO ADOPT RESOLUTION DIRECTING CONDEMNATION OF PROPERTY <br />WITHIN THE SANTORA PARTNERS DEVELOPMENT SITE <br /> <br />The Chairman announced that this is the time and place for the public <br />hearing on the issue of the public necessity to acquire by <br />condemnation property known as 214 North Sycamore Street, Santa Ana, <br />for redevelopment purposes. <br /> <br />. <br /> <br />5. <br />
