Mr. <br />Bricken questioned if this was in the agreement or if it was <br />a statement of content. Mr. Swanson responded that at this <br />time the agreement did speak to the issue of Homeowner <br />Associations. <br /> <br />After further discussion, a motion was made by Mr. Ward, <br />seconded by Mr. Bricken and carried by a vote of 5:1 (Mr. <br />Yamamoto casting the "NO" vote) to authorize the Chairman to <br />execute Consent to Assignment of Contract for Sale of Land <br />for Private Development, dated May 2,1977, as amended June <br />2, 1980, from Santa Ana Intown Apartments to Santa Ana <br />Intown Two; and Grant Deed and Declaration of Restrictions <br />conveying Subparcel 2 of Phase II of development site to <br />Santa Ana Intown Two and approve waiver by Agency of <br />redeveloper's obligation to procure faithful performance and <br />labor material payment bonds under Section 8(j) of Contract <br />for Sale of Land for Private Development, dated May 2,1977 <br />between the Agency and Santa Ana Intown Apartments with the <br />stipulation that there will be one Homeowner Association for <br />Phases I and II. <br /> <br />ASSIGNMENT OF OWNER PARTICIPATION AGREEMENT WITH MOHLER- <br />VISTA/EXECUTION OF GRANT DEED AND DECLARATION OF RESTRIC- <br />TIONS WITH OXFORD PROPERTIES, INC. <br /> <br />A motion was made by Mr. Bricken, seconded by Mr. Serrato <br />and carried by a vote of 4:1 (Mr. Yamamoto casting the "NO" <br />vote and Mr. Ward abstained) to approve Assignment of Owner <br />Participation Agreement with Mohler-Vista to Oxford <br />Properties, Incorporated and to authorize the Chairman to <br />execute the Grant Deed and Declaration of Restrictions with <br />Oxford Properties, Inc., a Colorado Corporation, covering <br />the conveyance of property pursuant to the Participation <br />Agreement dated February 19, 1980 between the Agency and <br />Mohler-Vista, a general partnership, and assignment to <br />Oxford Properties, Inc. prior to April 1, 1981. <br /> <br />ASSIGNMENT OF OWNER PARTICIPATION AGREEMENT WITH STEVEN J. <br />KEISER AND PAULA B. KEISER/EXECUTION OF GRANT DEED AND <br />DECLARATION OF RESTRICTIONS WITH PARKSIDE PLAZA <br /> <br />A motion was made by Mr. Bricken, seconded by Mr. Serrato <br />and carried unanimously to approve Assignment of Owner <br />Participation Agreement with Steven J. Keiser and Paula B. <br />Keiser to Parks ide Plaza and authorize the Chairman to <br />execute a Grant Deed and Declaration of Restrictions with <br />Parks ide Plaza, a general partnership, pursuant to the <br />Participation Agreement dated January 15,1979 between the <br />Agency and Steven J. Keiser and Paula B. Keiser and assigned <br />to Parks ide Plaza. <br /> <br />EXECUTION OF GRANT DEED AND DECLARATION OF RESTRICTIONS WITH <br />SANTA ANA OFFICE PLAZA <br /> <br />A motion was made by Mr. Griset, seconded by Mr. Ward and <br />carried unanimously to authorize the Chairman to execute a <br />'Grant Deed and Declaration of Restrictions with Santa Ana <br />Office Plaza, a California joint venture, covering the <br />conveyance of property pursuant to the Disposition and <br />Development Agreement dated December 17,1979 between the <br />Agency and Ross and Fifth Development Company and assigned <br />to Santa Ana Office Plaza. <br /> <br />-2- <br />
