<br />I~~ <br /> <br />8 <br /> <br />I <br /> <br />I <br /> <br />EXECUTIVE SESSION <br /> <br />At 8: 00 PM, the Legal Counsel requested that the Redevelopment Agency <br />recess to closed session to confer with its attorney regarding pending <br />litigation pursuant to Goverment Code Section 54956.9 (B) (1). The <br />Agency reconvened at 9:20 PM with the same members present. <br /> <br />JOINT PUBLIC HEARING REGARDING AMENDMENT TO DISPOSITION AND DEVELOPMENT <br />AGREEMENT FOR THE A-10 SITE WITH URBATEC AND OWNER PARTICIPATION <br />AGREEMENT WITH ACE MUFFLER TRANSMISSION, INC. <br /> <br />Mayor Griset announced it was the time and place for the Joint Public <br />Hearing of the Community Redevelopment Agency and the City Council of <br />the City of Santa Ana for the proposed sale of property by the Community <br />Redevelopment Agency of the City of Santa Ana to (1) Urbatec, a <br />California Corporation, and (2) Ace Muffler Transmission, Inc., a <br />California Corporation, et al. Mayor Griset called upon Sandi Daniels, <br />Agency Project Manager, to present the staff recommendation. Ms. <br />Daniels reported that the site proposed to be conveyed to Urbatec is <br />generally located at the northeast corner of Spurgeon Street and First <br />Street, extending north to Third Street and east approximately 760 feet <br />excluding property at the northeast corner of First Street and French <br />Street. Ms. Daniels added that the site proposed to be conveyed to Ace <br />Muffler Transmission, Inc., et al. (Ace Muffler) is located at 510 East <br />Second Street. Ms. Daniels clarified that two agreements were actually <br />involved, one with Ace Muffler and an amendment to an agreement which <br />was approved in July with Urbatec. The requested approvals are for a <br />95,000 square foot shopping center and for the rehabilitation and <br />integration into the shopping center of Ace Muffler. Mayor Griset <br />called for written communications, of which there were none. The Joint <br />Public Hearing was then opened to public comment. John MacLaurin, <br />President of Urbatec, spoke in agreement with the two proposed sales. <br />Mr. MacLaurin spoke of a process of long, hard work invested in the <br />development of the shopping center, adding that an executed agreement <br />with Boys Market has been achieved and that the possibility of tenancies <br />by Wendy's, Church's Chicken, and Thrifty Drug exists. Miguel Pulido <br />Jr., of Ace Muffler, also spoke in agreement with both of the proposed <br />sales. There were no speakers disagreeing with either of the two <br />proposed sales. Mr. Cooper requested that, in addition to the <br />previously requested resolution approvals, four instructions be <br />incorporated into Resolution 85-43. Mayor Griset declared the Joint <br />Public Hearing closed, It was moved by Mr. Luxembourger, seconded by <br />Mr. Young, and carried unanimously (5:0) that the Agency: <br /> <br />(1) Adopt Resolution No. 85-43: A RESOLUTION OF THE COMMUNITY <br />REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA APPROVING AN AMENDMENT TO <br />THE AGREEMENT BETWEEN THE AGENCY AND URBATEC, A CALIFORNIA CORPORATION; <br />and <br />
