<br />L. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. ~ <br /> <br />EXECUTIVE SESSION <br /> <br />The Agency adjourned to Executive Session at 7:04 P.M. and returned <br />to the Council Chambers at 7:16 P.M. with all members formerly <br />present in attendance. <br /> <br />The Agency Secretary read the following statements: <br /> <br />"The Legal Counsel requests that the Redevelopment Agency recess to <br />closed session pursuant to Government Code Sec. 54956.9(A) to confer <br />with its attorney regarding pending litigation which has been <br />initiated formally, and to which the Redevelopment Agency is a <br />party. The titles of the litigations are:1) Community Redevelopment <br />Agency vs. Judy's; and 2) Community Redevelopment Agency vs. Matkin." <br /> <br />"The Legal Counsel requests that the Redevelopment Agency recess to <br />closed session to confer with its attorney regarding pending <br />litigation pursuant to Government Code section 54956.9(c) to discuss <br />proposed litigation." <br /> <br />REPORT FROM EXECUTIVE SESSION <br /> <br />It was moved by Vice Chairperson McGuigan, seconded by Agency Member <br />May and carried unanimously (5:0) that the Redevelopment Agency <br />authorize the Agency's negotiator to settle the case of the <br />Community Redevelopment Agency vs. Matkin (No. 45-21-90) in the <br />amount of $125,000 plus legal interest. <br /> <br />It was moved by Agency Member Hart, seconded by Agency Member May <br />and carried unanimously (5:0) that the Redevelopment Agency <br />authorize the Chairman and the Secretary execute an agreement, as <br />approved by legal counsel, to settle the case which includes a <br />payment by the developer of $1 million for the Judy's leasehold <br />interest and execution of two leases by Judy's in Main Place. <br /> <br />ADJOURNMENT <br /> <br />There being no further business <br />meeting was adjourned at 7:21 P.M. <br /> <br />before <br /> <br />the Agency, the <br /> <br />to <br /> <br />come <br /> <br />~>t~ <br />Daniel H.
