<br />- ^, <br /> <br />RESOLUTION NO. 74-10 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA ADOPTING <br />A POLICY FOR THE EXERCISE OF THE POWER OF <br />EMINENT DOMAIN BY THE AGENCY WITHIN THE CITY <br />OF SANTA ANA REDEVELOPMENT PROJECT AREA <br /> <br />. <br /> <br />The Community Redevelopment Agency of the City of Santa <br />Ana DOES HEREBY RESOLVE AS FOLLOWS: <br /> <br />1. Eminent Domain Limitations. Except for public improvements, <br />facilities, and utilities, and for a period of seven (7) years, <br />the Agency shall use eminent domain only if the property to be con- <br />demned in the subject of an OWner Participation Agreement or Dis- <br />position and Development Agreement between the proposed participant <br />or developer and the Agency. After seven (7) years, it shall be <br />the, policy of the Redevelopment Agency not to use eminent domain <br />except for specific properties considered necessary to carry out <br />a successful financially economic plan productive for the taxpayers <br />of the City of Santa Ana, and then only after a noticed public hearing <br />held prior to the filing of any eminent domain action. <br /> <br />2. This resolution shall become effective upon the <br />dismissal with prejudice as to all parties defendant of <br />that action now pending in Orange County Superior Court entitled <br />Joseph L.
