Russell Cray spoke in favor of the appeal. <br /> <br />There were no other speakers on the matter. The Mayor closed the public <br />hearing. <br /> <br />Following discussion, MOTION was made by Bricken, seconded by Serrato, to <br />approve and file the Negative Declaration and instruct the City Attorney to <br />prepare a resolution granting Appeal No. 434, granting VA 80-68 without the <br />conditions as set forth by Planning Commission. <br /> <br />Motion passed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Griset, Luxembourger, Markel, Serrato, Ward <br />Yamamoto <br />None <br /> <br />CA 13.3 <br /> <br />PUBLIC HEARING STREET WIDENING - The Mayor announced that this was <br />NE CORNER OF SYCAMORE & EDINGER the time and place for the public <br />RES. NO. 81-39 ADOPTED hearing of the public interest and <br /> necessity to acquire by condemnation <br />the real property located at the northeast corner of Sycamore and Edinger for <br />street widening purposes. <br /> <br />The Public Works Director presented the staff report and recommendations. <br /> <br />The Clerk of the Council reported there were no written communications. <br /> <br />There were no speakers on the matter. <br /> <br />Following discussion, MOTION was made by Bricken, seconded by Luxembourger, <br />to find that the public interest and necessity require the proposed project; <br />that the project is planned and located in a manner that will be most compat- <br />ible with the greatest public good and the least private injury; and that the <br />property sought to be acquired is necessary for the project. <br /> <br />Motion passed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Griset, Luxembourger, Markel, Serrato, Ward, Yamamoto <br />None <br />None <br /> <br />The Mayor closed the public hearing. <br /> <br />Motion was made by Bricken, seconded by Yamamoto, to adopt the following <br />resolution: <br /> <br />RESOLUTION NO. 81-39 - A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA FINDING AND DETERMINING THAT <br />THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISI- <br />TION BY EMINENT DOMAIN OF CERTAIN REAL PROPERTY AT THE <br />NORTHEAST CORNER OF SYCAMORE AND EDINGER, SANTA ANA, <br />FOR STREET WIDENING PURPOSES AND AUTHORIZING AND DIRECT- <br />ING CONDEMNATION THEREOF. <br /> <br />Motion passed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Griset, Lu×embourger, Markel, Serrato, Ward, Yamamoto <br />None <br />None CA 29.8 <br /> <br />PUBLIC HEARING COMMUTER STATION ~ The Ma~vor announced that this was <br />1002 E.
