<br />, <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />KLG:ar <br />4/11/79 <br /> <br />RESOLUTION NO. 79-23 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY <br />OF THE CITY OF SANTA ANA CANCELLING A CERTAIN CON- <br />TRACT FOR DEMOLITION OF BUILDINGS DUE TO THE FAIL- <br />URE OF CONTRACTOR TO COMPLY IN GOOD FAITH WITH THE <br />REQUIREMENTS OF SAID CONTRACT; AND DIRECTING THE <br />CITY ATTORNEY, AS COUNSEL FOR SAID AGENCY, TO DO <br />ANY AND ALL THINGS NECESSARY TO ENFORCE THE OBLIGA- <br />TIONS OF SAID CONTRACTOR AND HIS SURETIES <br /> <br />WHEREAS, this Agency, on December 27,1977, awarded a <br />certain "CONTRACT FOR DEMOLITION OF EXISTING STRUCTURES <br />WITHIN AREA GENERALLY BOUNDED BY FIRST ST., FOURTH ST., <br />FORMERLY VAN NESS AVENUE, AND FLOWER ST." to Calvin C. <br />Crowley, doing business as CCC Land Clearing and Wrecking; <br />and <br /> <br />WHEREAS, this Agency has been informed that said con- <br />tractor is not complying in good faith with the requirements <br />and agreements of said contract, has failed and refused to <br />undertake work required hereby, or to complete work com- <br />menced by him heretofore, and that said contractor is in <br />default thereunder and can no longer be reached; and <br /> <br />WHEREAS, this Agency intends to pursue its remedies <br />under and pursuant to said contract. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDE- <br />VELOPMENT AGENCY OF THE CITY OF SANTA ANA, AS FOLLOWS: <br /> <br />1. That, pursuant to the provisions of said contract, <br />said contract is hereby cancelled for failure of said con- <br />tractor to comply in good faith with the requirements <br />thereof or to carry out and complete the work required of <br />him thereunder. <br /> <br />2. The city attorney is hereby directed to give notice <br />hereof to American Fidelity Fire Insurance Company, surety <br />of the bonds securing performance of said contract.
