<br />Greg Sanders, attorney represent-
<br />ing the Vietnamese Youth Club,
<br />addressed Council and reported
<br />that the Youth Club had applied
<br />for tax exempt status and no
<br />longer required the billiards
<br />
<br />Following discussion, MOTION was made by Luxembourger, seconded by McGuigan
<br />to support the decision of the Hearing Officer, based on the facts presented
<br />to the Hearing Officer at the time of the hearing, which recommends that
<br />the decision of the Chief of Police, denying the application of the Viet-
<br />namese Youth Club for a permit to conduct a business where games of
<br />billiards and pool are conducted, for premises located at 2327 W. Edinger,
<br />is upheld on the grounds that 1) the appellant's present operation falls
<br />within the requirements of Section 29-1, SAMC; and 2) that a Conditional
<br />Use Permit is required to enable Appellant to engage in those activities
<br />at its present site.
<br />
<br />At City Manager's request and agreed to by the maker and second, the second
<br />clause was stricken from the motion.
