Following discussion, MOTION was made by McGuigan, seconded by Acosta, to <br />to approve and file the Negative Declaration, and to instruct the City <br />Attorney to prepare a resolution approving VA 81-10 and affirming the <br />decision of the Planning Commission. <br /> <br />Motion passed on the following vote: <br /> <br />AYES: Acosta, Bricken, Griset, <br /> McGuigan, Serrato <br />NOES: None <br />ABSENT: None <br /> <br />Luxembourger, Markel, <br /> <br />CA 13 <br /> <br />PUBLIC HEARING - APPEAL The Mayor opened the public <br />APPLICATION #442 - EX 81-13, hearing of Notice of Exemption <br />3312 W. FIRST ST. and Appeal Application No. 441, <br />CA INSTRUCTED of the Zoning Administrator's <br /> denial of Minor Exception <br />81-13 to allow off-sale beer and wine (Type 20 License) in a mini-market, <br />"Toritos," within a self-service gas station in the C2 District at 3312 <br />W. First Street. <br /> <br />The Senior Planner presented the staff report and recommendations. <br /> <br />The Clerk of the Council reported there were no written communications. <br /> <br />Edward Frieson, 518 S. Bristol, spoke in favor of the appeal. <br /> <br />There were no other speakers on the matter. Flower Street. <br /> <br />The Senior Planner presented the staff report and recommendations. <br /> <br />The Clerk of the Council reported there were no written communications. <br /> <br />Michael Saba, the appellant, spoke in favor of the appeal. <br /> <br />There were no other speakers on the matter.
