<br />tÞ <br /> <br />I <br /> <br />. <br /> <br />- <br /> <br />REL:ms <br />5/27/80 <br /> <br />RESOLUTION NO. 80-56 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA APPROVING <br />AN AMENDMENT TO A CONTRACT FOR SALE OF LAND <br />FOR PRIVATE DEVELOPMENT WITH SANTA ANA INTOWN <br />APARTMENTS AND APPROVING AN AMENDED DECLARATION <br />OF RESTRICTIONS FOR THE LAND SUBJECT THERETO <br /> <br />WHEREAS, the Community Redevelopment Agency of the <br />City of Santa Ana and the Housing Authority of the City of <br />Santa Ana entered into i a "Contract for Sale of Land for <br />Private Development" with Santa Ana Intown Apartments on May <br />2,1977 for the development of land bounded by Ross Street <br />on the east, First Street on the south, Flower Street on the <br />west, and Third Street on the north ("subject site") for <br />multifamily residential use, and a certain "Declaration of <br />Restrictions" was executed on December 27, 1978 to restrict <br />the use of the easterly portion of the subject site in <br />accordance with the terms of said contract; and <br /> <br />WHEREAS, the parties now desire to amend the said <br />contract and execute an amended Declaration of Restrictions <br />in order to eliminate all restrictions based on the income <br />status of occupants of the dwelling units on the subject <br />site in order to promote the financing of the development as <br />condominiums; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY <br />REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br />1. That certain "First Amendment to <br />Sale of Land for Private Development," Form No. <br />a copy of which is on file in the office of the <br />Director of the Agency, is hereby approved, and <br />is authorized to execute the same. <br /> <br />Contract for <br />4/21/80 <br />ExecutJ.ve <br />the Chairman <br /> <br />2. That certain "Declaration of Restrictions <br />(Amended)," Form No. 6/2/80 , a copy of which is on <br />file in the office of the Executive Director of the Agency, <br />is hereby approved, and the Chairman is authorized to execute <br />the same as soon as the above said Amendment becomes effective <br />by its terms. <br /> <br />3.
