<br />EJC:adg <br />1/11/80 <br /> <br />RESOLUTION NO. 80-9 <br /> <br />. <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA AUTHORIZING <br />AND DIRECTING THE CONDEMNATION OF CERTAIN <br />REAL PROPERTY FOR REDEVELOPMENT PURPOSES <br />IN THE JONES DEVELOPMENT CORPORATION <br />DEVELOPMENT SITE IN THE CITY OF SANTA ANA, <br />STATE OF CALIFORNIA, AND DECLARING THE <br />PUBLIC NECESSITY THEREFOR <br /> <br />. <br /> <br />WHEREAS, in order to provide a redevelopment site, <br />pursuant to a participation agreement between the Community <br />Redevelopment of the City of Santa Ana and Jones Development <br />Corporation, a corporation organized under the laws of the <br />State of California, it has become necessary to acquire <br />certain real property located within the area bounded on the <br />North property line of Civic Center Drive West, East <br />property line of Flower Street, West property line of <br />Garnsey Street, and approximately 280 feet north of the <br />north property line of Civic Center Drive West, in the <br />redevelopment project area; and <br /> <br />~WHEREAS' all persons whose names and addresses <br />appear the last equalized assessment role for the <br />propert escribed herein and all persons whose names appear <br />as reco owners on the litigation guarantee reports for <br />said property, and all tenants were given notice and an <br />opportunity to be heard pursuant to Code of civil Procedures <br />Section 1245.235; and <br /> <br />WHEREAS, a public hearing has been held by the <br />Community Redevelopment Agency of the City of Santa Ana on <br />those matters set forth in its notice of intention to adopt <br />a resolution of necessity as referred to in Code of civil <br />Procedure Section 1240.030, which included the following <br />ma tters: <br /> <br />(a) Whether the public interest and necessity <br />require the proposed project; and <br /> <br />. <br /> <br />(b) Whether the project is planned and located <br />in the manner that will be most compatible with the <br />greatest public good and the least private injuries; <br />and <br /> <br />(c) Whether the property described herein is <br />necessary for the proposed project. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Community <br />Redevelopment Agency of the City of Santa Ana that it finds <br />and determines as follows: <br /> <br />1. The Community Redevelopment Agency of the <br />City of Santa Ana is specifically authorized by virtue of <br />Health and Safety Code Sections 33391 and 33342 to take <br />property by condemnation for redevelopment purposes, namely <br />redevelopment of real property situated within the area <br />described in the first recital hereinabove. <br /> <br />. <br /> <br />2. The property described herein is located <br />within the Community Redevelopment Project Area of the City <br />of Santa Ana as depicted by the Map attached hereto as <br />"Exhibi t A," and incorporated herein by reference, and is <br />necessary for the proposed project.
