RESOLUTION NO. 81-183 - A RESOLUTION CITY OF SANTA ANA DETERMINING THAT A NOT BE FORMED IN CONNECTION WITH THE STATION REDEVELOPMENT PROJECT. OF THE CITY COUNCIL OF THE PROJECT AREA COMMITTEE SHALL SANTA ANA INTERCITY COMMUTER RESOLUTION NO. 81-184 - A RESOLUTION CITY OF SANTA ANA DETERMINING THAT A NOT BE FORMED IN CONNECTION WITH THE REDEVELOPMENT PROJECT. OF THE CITY COUNCIL OF THE PROJECT AREA COMMITTEE SHALL SANTA ANA SOUTH MAIN STREET RESOLUTION NO. 81-185 - A RESOLUTION CITY OF SANTA ANA DETERMINING THAT A NOT BE FORMED IN CONNECTION WITH THE VARD REDEVELOPMENT PROJECT. OF THE CITY COUNCIL OF THE PROJECT AREA COMMITTEE SHALL SANTA ANA NORTH HARBOR BOULE- RESOLUTION NO. 81-186 - A RESOLUTION CITY OF SANTA ANA DETERMINING THAT A NOT BE FORMED IN CONNECTION WITH THE VARD REDEVELOPMENT PROJECT. OF THE CITY COUNCIL OF THE PROJECT AREA COMMITTEE SHALL SANTA ANA SOUTH HARBOR BOULE- Motion passed on the following vote: AYES: NOES: ABSENT: Acosta, Griset, Luxembourger, Markel, McGuigan, Serrato None Bricken CA 82.12 REQUEST FOR RECONSIDERATION STEWART ROTH - CONTINUED TO 11/16/81; RES. NO. 81-163 DENYING CUP 81-6 - DENIED MOTION was made by McGuigan, seconded by Markel, to reconsider Appeal No. 456, Conditional Use Permit 81-6, at 750 East Dyer Road. Motion passed on the following vote: AYES: NOES: ABSENT: Acosta, Luxembourger, Markel, McGuigan, Serrato None Bricken, Griset Stewart Roth, applicant for CUP 81-6, addressed Council requesting that Council reverse its decision to deny CUP 81-6 on the basis that he was not the owner of the property in question, that he was required to vacate the premises within 14 months, and the CUP would cause him undue financial hardship. The City Manager reviewed the circumstances involved with this particular application. Following discussion, MOTION was made by Griset, seconded by Serrato, to adopt the following resolution: RESOLUTION NO. 81-163 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AFFIRMING THE DECISION OF THE PLANNING COMMISSION DENYING CONDITIONAL USE PERMIT NO. 81-6 AND DENY- ING APPEAL NO. 456 FOR PROPERTY AT 750 EAST DYER ROAD. Motion FAILED on the following vote: AYES: NOES: ABSENT: Griset, Serrato Acosta, Luxembourger, Markel, McGuigan Bricken MOTION made by Acosta, seconded by McGuigan, to instruct the City Attorney to prepare a resolution granting Mr. Roth's appeal, was withdrawn. MOTION was made by Serrato, seconded by Markel, to continue the matter to November 16, 1981, in order to allow staff to meet with the applicant to discuss a mutually agreeable solution consisting of either 1) requiring minimal improvements for a 14-month period, or 2) a limited-term Condi- tional Use Permit to July 1, 1982 with review at that time.
