APPEAL NO. 464, CUP 81-25 Jay Kingery, 3001Redhill, Costa <br />& VA 81-36, 1501S. TROTTER Mesa, addressed Council repre- <br />CA INSTRUCTED senting Metropolitan Outdoor <br /> Advertising which filed Appeal <br />No. 464, appealing the Plannin§ Commission's denial of Conditional Use <br />Permit No. 81-25 and Variance Application No. 81-36, to allow construction <br />of an off-premise advertising sign (billboard) constructed within 80 <br />feet of the Newport Freeway and waiving height requirement for a 60-foot <br />sign in the M1 District at 1501 S. Trotter. <br /> <br />Following discussion, MOTION was made by Griset, seconded by Markel, to <br />approve and file the Negative Declaration and instruct the City Attorney <br />to prepare a resolution denying Appeal No. 464, denying CUP 81-25 and <br />VA 81-36, and affirming the decision of the Planning Commission. <br /> <br />Motion failed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Griset, Markel, McGuigan <br />Acosta, Bricken, Luxembourger, Serrato <br />None <br /> <br />MOTION was made by Acosta, seconded by Luxembourger, to approve and file <br />the Negative Declaration and instruct the City Attorney to prepare a <br />resolution granting Appeal No. 464, granting CUP 81-25 and VA 81-36, <br />and overruling the decision of the Planning Commission, with the follow- <br />ing stipulations: <br /> <br />1. Permit the sign to be located 35 feet above the Newport <br /> Freeway roadway; <br />2. Allow a 5-year term on the sign with a 5-year renewal <br /> option; <br />3. Delete donated sign space requirement; and <br />4.
