FIRST STREET <br />(PROJECT 1819) <br /> <br />APPROVED <br /> <br />o As Recommended <br />o As Amended <br />o Ordinance on 15t Reading <br />o Ordinance on 2nd Reading <br />o Implementing Resolution <br />o Set Public Hearing For <br /> <br /> <br /> <br />/'/ <br />" ~L. <br /> <br />CONTINUED TO <br /> <br />-- ----- -,..~ <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />Direct the City Attorney to prepare and authorize the City Manager and <br />Clerk of the Council to execute a rental agreement with property owners <br />Creighton Hunter, Betty Hunter, Fred Orgeron and Brenda Orgeron totaling <br />$33,000. <br /> <br />DISCUSSION <br /> <br />The Bristol Street widening proj ect from Pine Street to Third Street <br />requires acquisition of the property located at 1249 W. First Street <br />(Exhibit 1). On February 22, 2005, the City Council approved a relocation <br />agreement with Apollo Muffler shop, the tenant at 1249 W. First Street. <br />Apollo Muffler plans to vacate the property on March 31, 2005. In order <br />to avoid incurring any additional relocation costs, Federal regulations <br />require execution of a rental agreement with the property owners to <br />insure fair compensation under the current lease with Apollo Muffler <br />shop. <br /> <br />The rental agreement will authorize payment to the property owner in the <br />amount of $3,300 per month, for a maximum of 10 months. During that <br />time, staff will continue negotiations with the property owners to reach <br />a settlement. Rent will be paid up to the date the City acquires <br />ownership of the property. <br /> <br />ENVIRONMENTAL IMPACT <br /> <br />In accordance with the California Environmental Quality Act, the proposed <br />project has been determined to be adequately evaluated in previously <br />prepared Environmental Impact Report/Environmental Impact Assessment EIR <br />No. 89-01 approved by City Council in 1990. <br /> <br />25E-1 <br />
