<br />City Place <br />Focused Env;ronmentallmpact Report <br /> <br />Findings and Facts in Support of Findings <br /> <br />C-I <br /> <br />If buried cultural material is encountered during project construction, the construction <br />contractor shall immediately stop work within immediate vicinity of tbe finding and the <br />City's Environmental Coordinator shall be contacted for appropriate action. <br /> <br />C-2 <br /> <br />If human remains are encountered during construction activities, work shall cease and the <br />Orange County Coroner's Office and the Native American Heritage Commission shall be <br />notified. A course of action will be agreed upon regarding the treatment of said remains <br />with the Orange County Coroner's Office or in compliance with the Native American <br />Graves Protection and Repatriation Act (NAGPRA) and the Native American Heritage <br />Commission if the remains are determined to of Native American origin. This process can <br />involve, but is not limited to re-interment of said remains on- or ff site, donation to museums <br />or schools for the promotion of archaeological body of record or other arrangements as <br />agreed upon by the consultation process with the Native American descendents or their <br />representative. <br /> <br />Level of Significance ofImpacts Related to Cultural Resources <br /> <br />The adverse impacts of the City Place project related to cultural resources during construction <br />will be mitigated to below a level of significance based on the implementation of mitigation <br />measures C-I, and C-2, provided above. <br /> <br />4.2.3 <br /> <br />Impacts Related to Hydrology and Water Quality <br /> <br />Potentiallv Significant Adverse Imoacts Related to Water Oualitv Impacts <br /> <br />As discussed in Section 4.6 in the EIR, the construction and operation of the City Place project <br />may result in the potential for significant adverse impacts to water quality associated with <br />contaminants on the site being carried fTom the site in runoff. <br /> <br />Findings Related to Water Ouality Impacts <br /> <br />Changes or alterations haye been required in, or incorporated into, the project which avoid or <br />substantially lessen the significant environmental effect as identified in the EIR. <br /> <br />Facts in Supoort of the Finding Related to Water Oualitv Impacts <br /> <br />Implementation of mitigation measures W-3 during construction and W-4 during operation, <br />provided below, wiU substantially lessen the adverse impacts of the City Place project related to <br />water quaJity during construction, and will reduce this potentially significant adverse impact to <br />below a level of significance. <br /> <br />For Construction (Storm Water Pollution Prevention Plan (SWPPP) <br /> <br />W-3 Prior to the commencement of soil disturbing activities, the project proponent sbaU submit <br />for approval to the Regional Water Quality Control Board (RWQCB), a Notice of Intent to <br /> <br />C:\Dnrument... and Settin,:s\BKaufmanlLocal Set/ings\Temporary Internet FileslOLKBICity Placefindings.doc <br /> <br />Pagt: <br /> <br />Påge 32 of 53 <br />
