<br />. <br /> <br />. <br /> <br />. <br /> <br />City Place <br />Focused Enyironmental Impact Report <br /> <br />Findings and Facts in Support of Findings <br /> <br />technological and/or other benefits outweigh the unavoidable significant adverse environmental <br />impacts of the project. Section l5093(b) of the CEQA Guidelines provides that when the decision <br />of a public agency results in the occurrence of significant adverse impacts that are identified in the <br />Final EIR but are not substantially mitigated, the agency must state in writing the reasons to <br />supports its actions based on the Fina] EIR and/or other information in the record. The reasons set <br />forth below are based on the Final EIR and other information in the record. <br /> <br />Based on the substantial evidence in the record, including but not limited to the Final EIR, the City <br />finds that the benefits of the City Place project outweigh its unavoidable adverse environmental <br />impacts and, furthermore, finds that such adverse environmental effects are acceptable. Each ofthe <br />separate benefits of the project, as stated below, is determined to be, unto itself and independent of <br />other project benefits, a basis for overriding all unavoidable adverse impacts identified in these <br />Findings. The reasons for the approval of the project despite the occurrence of significant <br />unavoidable adverse impacts related to short and long term air quality, and surface transportation <br />are: <br /> <br />I. The project would allow the City to achieve the objectives which avoiding or minimizing <br />significant adverse environmental impacts to the extent feasible. The project will: <br /> <br />. <br /> <br />Result in the development of the site as a commercial and residential center that provides <br />entertainment, shopping, dining and living opportunities for the residents of Santa Ana and <br />surrounding areas <br /> <br />. <br /> <br />Maximize the advantages of the sites location on Main Street in terms of its yisibility and <br />proximity to SR 22. <br /> <br />. <br /> <br />Develop the vacant project site with land uses to help meet the retail and residential needs <br />within the northeastern area of the City of Santa Ana. <br /> <br />. <br /> <br />Expand live/work residential opportunities in the City of Santa Ana. <br /> <br />. <br /> <br />Provide commercial space suitable to attract retail tenants consistent with existing retail uses <br />in the immediate]y surrounding areas. <br /> <br />. <br /> <br />Provide a project that is consistent with the commercial and residential uses in the <br />surrounding area and to contribute to the continued revitalization of the northeastern area of <br />the City of Santa Ana. <br /> <br />2. <br /> <br />Approval oftbe project would bolster the economic and social bealth of the northemmost part <br />of the City of Santa Ana by aiding in the re-establishment of businesses in the project area by <br />stimulating and attracting private investment, thereby improving the City's economic health, <br />employment opportunities and the tax base. <br /> <br />3. <br /> <br />The project would be consistent with existing development in the area which reflects an urban <br />environment preserving the aesthetics qualities of the City and helping to make the area a <br />source of pride to people living and working in Santa Ana and for visitors to the City. <br /> <br />C:\Documents and SettingslBKaufmanlLocal SeltingslTemporary Internet Files\OLKB\City Place findings. doc <br />September 29.2004 Resolution 2005-016 <br />Page 51 of 53 <br /> <br />Page <br />
