The parties entered into Agreement A-2003-225, dated November 3, 2003, <br />(hereinafter "said Agreement") by which Consultant has provided janitorial services <br />for the Santa Ana Police Department, Jail Facility and grounds. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase compensation to pay for services during the second year of a three-year term. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 2. a, COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A-I, attached to this First Amendment. <br />Compensation to be paid during this second year of said Agreement shall not exceed <br />$370,000.00 during the term from December 1, 2004 through November 30, 2005. <br />Total compensation to be expended under this Agreement shall not exceed <br />$707,000.00 during the term of said Agreement." <br /> <br />2.
