FOUNDATION ORANGE COUNTY, AND <br />SOLARI ENTERPRISES, INC. <br /> <br />This First Amendment to the Cooperative Agreement ("Amendment") is hereby <br />entered into this A day of Odo~ , 2004, by and between the City of Santa Ana <br />("City"), the A.S. Foundation Orange County ("Project Sponsor"), and Solari Enterprises, <br />Inc. ("Contractor"). <br /> <br />RECITALS: <br /> <br />A. City on behalf of all jurisdictions in Orange County, has been designated to <br />receive grant funding provided by the U.S. Department of Housing and Urban <br />Development ("RUD") pursuant to the Housing Opportunities for Persons With AIDS <br />("HOPW A") Program, and City has entered into a HOPW A grant agreement with HUD. <br /> <br />B. Project Sponsor has provided leadership and is responsible for planning and <br />providing comprehensive HN services for clients throughout Orange County and will <br />maintain the wait list for the program; and <br /> <br />C. Project Sponsor contracted with Contractor to obtain services to support the <br />Tenant-Based Rental Assistance Program consisting of financial eligibility of tenants, <br />HQS inspections, and financial responsibility for housing assistance payments to <br />landlords, and the parties have cooperatively written and agreed to an Administrative <br />Plan which identifies guidelines for the operation of the HOPW A Tenant-Based Rental <br />Assistance Program ("Program"). <br /> <br />D. During the last year, the costs involved in effectively running the Program <br />have increased substantially, requiring additional funding by the City in order to continue <br />running said Program. <br /> <br />E. Due to increases in Orange County rents, the direct Housing Assistance <br />Payment portion ofthe contract was over budget. In past years all funds were not <br />expended, therefore, the parties desire to amend the Cooperative Agreement with these <br />funds, adding an additional Forty Five Thousand Dollars to the Cooperative Agreement. <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises <br />contained in the Agreement, and subject to all the terms and conditions of the Agreement, <br />City and the Project Sponsors agree as follows: <br /> <br />1. The Agreement shall be amended to include in Section III. Budget, an additional <br />Forty Five Thousand Dollars ($45,000) for a total Maximum Obligation of Five <br />Hundred Forty Five Thousand Dollars ($545,000). <br /> <br />1 <br />
