'1 , 1979, by and between the City of Santa Ana, a municipal corporation of the State of California ("CITY"), and Kinkle, Rodiger and Spriggs, a professional corporation ("ATTORNEYS"), WIT N E SSE T H ---------- Recitals: 1. The parties hereto entered into a certain agreement dated August 2, 1976, for the purpose of employing ATTORNEYS to assist the City Attorney in the defense of actions for damages against CITY, its agencies, officers and employees. 2. CITY and ATTORNEYS desire to amend the fee schedule of said agreement. WHEREFORE, in consideration of the respective and mutual covenants and promises hereinafter contained and made, and subject to all the terms and conditions hereof, the parties hereto do hereby agree as follows: I. It is agreed by the parties hereto that, effective January 1, 1979, paragraph B, of said agreement is modified to read as follows: B. Payment for Services Rendered CITY agrees to pay to ATTORNEYS, and ATTORNEYS agree to accept from CITY, as and for payment in full for all of said services in regard to each such action, a fee equal to the reasonable value of said services, determined as follows: l. Superior Court Work $60.00 per hour. 2. Municipal Court Work $50.00 per hour. II.
