<br />032305155 <br /> <br />RESOLUTION NO. 2005-035 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING THE APPLICATION FOR LAND <br />AND WATER CONSERVATION FUNDS TO BUILD <br />RESTROOM FACILITIES FOR THE KIWANIS BARRIER- <br />FREE PLAYGROUND AT CARL THORNTON PARK <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A Congress, under Public Law 88-578, has authorized the establishment of <br />a federal Land and Water Conservation Fund Grant-In-Aid program, providing Matching <br />funds to the State of California and its political subdivisions for acquiring lands and <br />developing facilities for public outdoor recreation purposes; and <br /> <br />B. The California Department of Parks and Recreation is responsible for <br />administration of the program in the State, setting up necessary rules and procedures <br />governing Applications by local agencies under the program; and <br /> <br />C. Said adopted procedures established by the State Department of Parks <br />and Recreation require the City of Santa Ana to certify by resolution the approval of <br />application(s) and the availability of eligible matching funds prior to submission of said <br />application(s) to the State; and <br /> <br />D. The building of restroom facilities for the Kiwanis Barrier-Free Playground <br />at Carl Thornton Park (Project) is consistent with the Statewide Comprehensive <br />Recreation Resources Plan California Outdoor Recreation Plan - 2002; and <br /> <br />E. The Project is compatible with the land use plans of those jurisdictions <br />immediately surrounding the Project. <br /> <br />Section 2. The City Council approves the submittal of an application for <br />$270,000 in Land and Water Conservation Fund assistance to build restroom facilities <br />for the Kiwanis Barrier-Free Playground at Carl Thornton Park; and <br /> <br />Section 3. The City Council certifies that the City has matching funds from <br />Park Acquisition and Development Funds and can finance 100 percent of the Project, <br />half of which will be reimbursed; and <br /> <br />Section 4.
