<br />(2) The FAA considered and analyzed the impact <br />on all existing and planned public-use airports, <br />military airports and aeronautical facilities. <br /> <br />(3) The FAA considered and analyzed the <br />cumulative impact resulting from the proposed <br />structure when combined with the impact of <br />other existing or proposed structures. <br /> <br />(4) The ALUC "considers and recognizes the FAA <br />as the single 'Authority' for analyzing project <br />impact on airport or aeronautical operations, or <br />navigational-aid siting, including interference <br />with navigation-aids or published flight paths <br />and procedures." AELUP, 9 2.1.3, Page 14. <br /> <br />e) A Tom Krause Aviation Consulting report entitled <br />Geneva Commons Aviation Impact Analysis, <br />Instrument Approach, Departure Procedure and VRF <br />Analysis of John Wayne Airport (hereinafter "Krause <br />Analysis") concluded that the project would not pose <br />an adverse impact on any Instrument Approach <br />Procedures, Departure Procedures or VFR <br />Procedures at JWA. (Attached hereto as Exhibit B.) <br /> <br />f) Based on the FAA's Aeronautical Study, the Krause <br />Analysis, and the lack of factual evidence by JW A or <br />the ALUC to the contrary, the proposed project: <br /> <br />(1) Is not a hazard to air navigation. <br /> <br />(2) Does not raise the ceiling or visibility minimums <br />at JW A for an existing or planned instrument <br />procedure. <br /> <br />(3) Does not result in a loss of JWA's utility. <br /> <br />(4) Does not conflict with the VFR air space use <br />for the JW A traffic pattern or for en route <br />navigation to and from JW A. <br /> <br />g) Therefore, based upon the above, this project is <br />consistent with the safe operations, both existing and <br />proposed, of JWA.
